Quick answer
Plan backwards from the earliest event that could legally amount to the marriage, not only from the reception date. Allow separate time for status screening, instructions, financial evidence, advice, drafting, revisions, execution, deeds-registry examination and proof of registration. Do not treat the three-month registration period as permission to sign the ANC after the marriage.
How to use this guide
The useful output is a critical-path calendar with an owner and evidence for every stage.
Keep three legal clocks separate
Clock 1: execution before marriage
The ordinary ANC must be executed while the parties are still intended spouses. If a civil, customary or other legally effective marriage may already exist, pause the routine workflow and obtain advice. Do not backdate a deed or assume that a later civil ceremony resets an earlier customary-marriage date.
Where customary-marriage timing is uncertain, use the specialist customary-marriage and ANC timing guide. That page owns the status analysis; this page only identifies uncertainty as a critical-path stop.
Clock 2: actual deeds-registry registration
For an ANC executed in South Africa, section 87(1) of the Deeds Registries Act requires registration within three months after execution unless a court allows an extended period. For an ANC executed outside South Africa, section 87(2) provides a six-month period and additional formality considerations.
Registration means the registry process has reached legal registration. Delivery to a firm, dispatch to a correspondent and lodgement at a deeds registry are earlier milestones. Keep separate evidence for each one so that an optimistic status update is not mistaken for completion.
Clock 3: a commencement-value statement
Where accrual applies, section 6 of the Matrimonial Property Act permits a commencement value that was not declared in the ANC to be declared in a separate statement before the marriage or within six months afterwards, subject to the statutory signature, notarial-attestation and protocol requirements.
That six-month rule concerns proof of a commencement value. It does not extend the deadline for executing the ANC or the deadline for registering it. Label the statement as its own task if it is relevant.
Build the critical-path calendar
| Stage | Dependency to clear | Responsible owner | Completion evidence | Delay warning |
|---|---|---|---|---|
| Status screening | Complete relationship and ceremony chronology | Intended spouses and practitioner | Written status assumption or escalation | Any prior or possible existing marriage is unresolved |
| Instructions | Choice issues and facts identified | Intended spouses | Agreed instruction note | The parties use labels but disagree on practical consequences |
| Evidence pack | Identity, status, asset, debt and value records | Each intended spouse | Indexed pack with gaps recorded | Names, values, ownership or prior-status documents conflict |
| Advice | Accrual, exclusions and tailored terms explained | Responsible practitioner | Questions resolved and decisions recorded | One party does not understand or wants separate advice |
| Drafting | Complete instructions and supporting descriptions | Practitioner | Version-controlled draft | Late changes affect exclusions, values or other clauses |
| Execution | Final deed, attendance and originals ready | Notary and intended spouses | Dated executed deed | Marriage event may occur first |
| Lodgement | Execution complete and registry pack prepared | Notary or named correspondent | Lodgement evidence | Filing responsibility or registry is unclear |
| Examination and correction | Registry review | Lodging practitioner | Query response and updated status | A query is reported without an owner or return date |
| Registration | Registry endorsement completed | Deeds registry and lodging practitioner | Registration particulars or appropriate copy | Lodgement is being described as registration |
| Value statement, if used | Values and statutory formality settled | Intended spouses and notary | Attested statement filed in protocol | The separate six-month period is confused with the ANC |
Put the intended marriage date, execution target, statutory registration deadline and any value-statement deadline on different rows. A single “ANC due” entry hides too much.
Delay risk 1: uncertainty about marital status
The fastest drafting process cannot cure an incorrect assumption that the parties are still unmarried. Give the practitioner every potentially relevant event: prior marriages and divorces, customary negotiations or celebrations, religious ceremonies, civil unions, foreign marriages and any planned civil ceremony.
This is not a request for a long legal history where none exists. It is a control against discovering too late that the ordinary ANC window may already have closed. If documents are missing, assign someone to obtain them and record a decision date for escalation.
Delay risk 2: unresolved financial instructions
An ANC can take longer when the parties have not decided what result they want or cannot describe the assets involved. Common dependencies include:
- whether accrual will apply or be expressly excluded;
- commencement values and the evidence supporting them;
- precise descriptions of assets proposed for exclusion;
- companies, close corporations, partnerships, professional practices, trusts or loan accounts;
- liabilities, suretyships and security arrangements; and
- foreign assets or advice about another country’s law.
The notary must work from the facts, not from vague references such as “my business” or “the house”. The ANC documents guide shows how to build the evidence index without duplicating the calendar here.
Delay risk 3: draft review and independent understanding
Allow time for both intended spouses to read the whole draft and ask questions. A late disagreement about accrual, exclusions, valuations or death consequences can require further advice and a revised instrument. Where interests diverge or one person does not understand the effect, independent advice may be appropriate.
Do not compress this stage into a rushed signing appointment. Record the version approved for execution and freeze further changes unless the notary issues a new version.
Delay risk 4: attendance, foreign execution and originals
Availability becomes critical where one person travels, lives abroad, needs an interpreter, has a name mismatch or cannot produce the required original identity and status records. Do not assume that remote signature, electronic signature, a representative or a foreign notary will be accepted for the proposed instrument.
Ask the responsible notary to confirm the execution route in writing. If execution will occur outside South Africa, record the place, permitted form, return method and the different section 87(2) registration period. The foreign-use or foreign-execution path may add translation, local formality, courier and authentication dependencies.
Delay risk 5: registry queries and proof
After execution, the lodging professional must prepare and submit the registry package. Examination can identify formal defects, inconsistent descriptions or missing supporting material. A response may require a corrected document, further affidavit, additional authority or another step that depends on the facts.
Ask for milestone reporting that distinguishes:
- the ANC was executed;
- the registration package was prepared;
- it was lodged;
- a query or rejection was raised;
- the response was submitted;
- registration occurred; and
- the registration particulars or appropriate copy were delivered.
No online guide can promise the duration of those stages. Use dated provider estimates, add a correction buffer and escalate when a promised update is missed.
A weekly control routine
Until execution, review the calendar at least weekly and more often when the marriage date is close. For each open dependency, record:
- the named owner;
- the requested item or decision;
- the date requested;
- the next follow-up date;
- what downstream stage is blocked; and
- the point at which the ordinary plan is no longer safe.
After execution, keep the registration owner and statutory deadline visible until actual registration evidence is received. If the registration period is at risk, obtain specific legal advice promptly. A court extension is not automatic or guaranteed.
FAQs
Can an ANC be signed during the three months after the wedding?
No. The ordinary ANC must be executed before the marriage. The three-month period in section 87(1) concerns registration after South African execution, not permission to sign after marriage.
What is the registration period for an ANC executed outside South Africa?
Section 87(2) provides a six-month registration period after foreign execution, unless a court allows an extension. The responsible notary must also confirm the permitted execution form and South African registration route.
Does the six-month commencement-value statement extend ANC registration?
No. The Matrimonial Property Act section 6 statement is a separate proof mechanism for a commencement value. It does not extend either the pre-marriage execution requirement or the deeds-registration period.
Does lodgement prove that the ANC is registered?
No. Lodgement is an earlier registry milestone. Ask for the registration particulars or appropriate registered record and keep query or correction stages separate.
