Quick answer
Use a red, amber and green escalation test:
How to use this guide
- RED — get help now: safety, coercion, imminent signing, a court or response date, threatened disposal or transfer of an important asset, imminent pension or property action, or a child-related step that may be difficult to reverse.
- AMBER — book targeted advice before the next decision: the matrimonial-property regime is uncertain, disclosure is incomplete, values are materially disputed, or the matter includes a pension, business, trust, foreign asset, maintenance issue or creditor obligation.
- GREEN — organise and negotiate for now: there is no immediate deadline or safety risk, both spouses can communicate freely, the regime and asset list are reasonably clear, information is being exchanged, and nobody is being asked to sign, transfer, waive or file anything final.
“Green” does not mean legal advice will never be needed. It means the next safe step can remain administrative or exploratory. If more than one colour applies, use the highest-risk colour.
This page’s exclusive purpose
This article covers the timing and level of legal-help escalation. It does not provide a complete divorce roadmap, choose a lawyer, assemble the full document pack, preserve every financial record or decide whether a particular agreement is ready to sign.
Its work product is one urgency card containing: trigger, possible consequence, controlling date, safe immediate action and minimum advice pack.
RED: get help now
| Trigger | Why it is red | Safe immediate action |
|---|---|---|
| Violence, stalking, threats, economic abuse or pressure to meet or sign | Safety and voluntariness cannot be protected by ordinary negotiation | Move to safety where possible; contact SAPS on 10111 for a police emergency; ask about a protection order and safe legal communication |
| A summons, notice, court date or written response deadline | Missing the matter-specific date may affect available procedural options | Record the date exactly, keep the complete document and seek advice without waiting for informal negotiations |
| A home, business interest, vehicle, investment or material asset may be sold, transferred, encumbered or dissipated imminently | Later compensation may not be an adequate practical substitute; the remedy depends on the regime and facts | Preserve lawful proof of the threat and obtain urgent advice about available relief |
| A pension benefit, resignation, retirement or fund transaction is imminent while treatment remains unresolved | “Pension interest” and payment mechanics are statutory and time-sensitive | Record the fund, member, event and date; seek advice before agreeing to wording or assuming the benefit can later be recovered |
| You are expected to sign a “full and final” settlement immediately | A signature may affect negotiations and later proceedings; no general cooling-off period should be assumed | Do not sign a blank, incomplete or unreviewed version; use the pre-signing release gate |
| A child may be removed from South Africa, hidden, or placed in immediate danger | Guardianship, safety and child-focused remedies require urgent, fact-specific action | Obtain urgent family-law advice and contact appropriate emergency or child-protection services where necessary |
Red does not guarantee that a court will grant urgent relief. It means the cost of waiting may be materially greater than the cost of obtaining immediate advice.
The Matrimonial Property Act contains different protections depending on the regime. Section 15 regulates consent for specified transactions in a marriage in community of property, while sections 8 and 20 contain forms of relief where conduct meets serious-prejudice tests. These provisions have requirements, exceptions and third-party consequences. Do not use them as a do-it-yourself cancellation notice or describe them as an automatic asset freeze.
AMBER: obtain advice before the next commitment
Amber is the correct category where nothing must happen today, but the next substantive choice requires legal analysis.
| Trigger | Main uncertainty | Advice should answer |
|---|---|---|
| You cannot confirm the matrimonial-property regime | The asset claim may be framed on the wrong legal basis | Which regime and current remedy apply, and which facts could change the answer? |
| One spouse controls important information | Negotiation may use an incomplete asset picture | What information is material and what lawful disclosure route is proportionate? |
| A home has a bond or one spouse wants to retain it | Ownership, occupation, bond liability and transfer are separate | What must the settlement, bank process and conveyancing implementation each address? |
| There is a pension or retirement interest | The everyday account value may differ from the statutory concept | Which fund details, formula and order wording are required? |
| A business, trust or foreign asset is material | Legal ownership, control and value may differ | What must be valued, disclosed or reserved before settlement? |
| A maintenance waiver or long-term payment is proposed | Need, affordability, duration and enforceability may have lasting effects | What evidence and drafting are required for the proposed term? |
| The spouses disagree materially on value or debt | “Splitting the difference” may conceal different assumptions | Which valuation date, expert input or adjustment mechanism is appropriate? |
| Minor-child arrangements remain unresolved | The court must address child welfare independently of the asset bargain | Whether Family Advocate involvement, a parenting plan or another child-focused step is appropriate |
Amber advice can be narrow. You may need an opinion on the regime, a pension clause or a property implementation term rather than immediate representation for the entire divorce.
Current law is one amber trigger. The Constitutional Court’s interim reading-in in EB v ER; KG v Minister of Home Affairs remains relevant to some redistribution claims as at 25 August 2026 while the General (Family) Laws Amendment Bill is still pending. Do not rely on an old pre-or-post-1 November 1984 shortcut for marriages out of community without accrual.
GREEN: handle the organisational stage yourself
Green is available only while all of the following remain true:
- nobody faces an immediate safety concern;
- no court, signing, sale, transfer or other controlling date is close;
- both spouses can communicate without threats or coercion;
- the marriage documents and broad property regime are available;
- a good-faith asset and debt list is being exchanged;
- material values are known or openly marked for later valuation;
- nobody is trying to hide, move or destroy property or records;
- child arrangements are stable enough that no urgent intervention is needed; and
- the next step is gathering, comparing or discussing—not waiving or finalising rights.
Green tasks include creating a neutral list of agreed and disputed items, recording questions, proposing a valuation process, and identifying decisions that need professional input. Do not access another person’s account, email or device without authority. Do not move or hide assets to create leverage.
Move from green to amber as soon as the legal regime, disclosure or implementation becomes uncertain. Move directly to red if a deadline, threat or potentially irreversible event appears.
Complete the urgency card
Use one row for every concern:
| Trigger | Possible consequence | Controlling date | Safe immediate action | Minimum advice pack | Colour |
|---|---|---|---|---|---|
| Example: draft must be signed | Broad release or incorrect pension term | Date stated in message | Do not sign; request complete final version | Draft, message creating date, marriage document, disputed-clause note | Red |
| Your issue |
The controlling date must come from the actual document or event. Do not substitute a general internet timeframe for a summons, court direction, fund event, transfer appointment or protection-order return date.
The safe immediate action should preserve options without deciding the merits. Examples are retaining the document, asking for the complete version, recording a reference number, preserving lawful proof or stating that advice is being obtained. It should not be a threat, an asset transfer or an admission.
The minimum advice pack
For urgency triage, take only what lets the adviser identify the route:
- the document, message or event creating the urgency;
- the marriage certificate and antenuptial contract if available;
- a one-page list of unresolved assets and debts;
- the relevant latest statement, draft or ownership record;
- a short dated timeline; and
- the outcome you need protected immediately.
This is not the complete divorce preparation pack. Use the dedicated documents guide if the matter moves beyond triage.
Child and safety routes are separate from asset negotiation
Section 6 of the Divorce Act protects the interests of minor or dependent children in divorce proceedings. The Office of the Family Advocate assists with disputes about parental responsibilities and rights, parenting plans and court recommendations. It is neutral, does not represent either spouse and does not determine the asset dispute.
The Domestic Violence Act and official protection-order process address domestic violence, including relevant economic or controlling abuse. A person in immediate danger should prioritise safety and emergency assistance over keeping negotiations amicable. SAPS identifies 10111 as its police-emergency number.
Do not use mediation or a joint meeting where it would expose someone to intimidation or undermine safety planning.
Decide how much legal help is proportionate
Legal help is not all-or-nothing. Depending on the colour and problem, the useful instruction may be:
- an urgent safety or preservation consultation;
- interpretation of the matrimonial-property regime and current remedies;
- review of one pension, maintenance or property clause;
- advice on disclosure or valuation;
- review before signing;
- drafting or negotiation of the settlement; or
- representation in a contested process.
Ask the adviser to identify the immediate protected step, what work is included, the records still needed, the next decision and the fee basis. This page does not own general provider selection; it helps define urgency and scope.
For the broader self-representation question, use can you divorce without a lawyer in South Africa?. For the end-to-end procedural route, use the South African divorce process guide.
People who cannot afford private representation can check Legal Aid South Africa’s current qualification rules. Its official material includes divorce and disputes about children among matters it may assist with, subject to its rules and assessment.
Apply the matrix to common situations
- A draft arrives with no real deadline and complete information: amber until the legal and implementation terms are reviewed; then apply the pre-signing release gate.
- A spouse refuses one bank statement but there is no imminent event: amber; define the material gap and lawful disclosure route.
- A property sale is scheduled while ownership or proceeds are disputed: red; preserve the notice and obtain urgent advice.
- Both spouses are listing assets and arranging a joint valuation without pressure: green for organisation, amber before agreeing the final legal treatment.
- Direct contact is threatening or unsafe: red regardless of the asset value.
Disclaimer
This South African escalation matrix is general information, not legal advice or a prediction that urgent relief will be granted. The correct route depends on the marriage, documents, court, safety facts, property regime and threatened event.
FAQs
Does an asset disagreement automatically mean I need a lawyer today?
No. If there is no deadline, threat, signing request or complex legal issue, the organisational stage may remain green. Move to amber before making a commitment based on an uncertain regime, value or legal consequence.
What if my spouse says the agreement must be signed today?
Treat the claimed deadline as red until its source and consequence are checked. Ask for the complete final draft and the reason for the date. Do not assume a general cooling-off period will undo a hurried signature.
Is a threatened sale of an asset always unlawful?
Not necessarily. Ownership, the matrimonial regime, required consent, third-party rights and facts matter. An imminent transaction affecting a material disputed asset is a reason for urgent advice, not a basis for declaring it invalid yourself.
When does a pension issue become urgent?
Escalate when a resignation, retirement, withdrawal, fund payment or proposed divorce order is approaching while pension treatment remains unresolved. Obtain advice on the actual fund and statutory concept rather than relying on an account balance.
Can the Family Advocate settle our asset dispute?
No. The Family Advocate’s role is child-focused. It may assist with parental-responsibility disputes, parenting plans and recommendations, but the property settlement requires a separate process or advice.
What if I cannot afford a private divorce lawyer?
Check Legal Aid South Africa’s current eligibility and matter rules. You can also define a narrow instruction, such as regime classification or review of one clause, when full representation is unnecessary, although availability and fees remain provider-specific.
