Quick answer
Get urgent immigration advice when the permanent-residence matter is connected to an expiring or disputed temporary status, a refusal or adverse notice, imminent travel, a missed response date, alleged misrepresentation, an untraceable application, or a material change that could make the filed information inaccurate.
How to use this guide
Elapsed processing time alone is not always an emergency. First separate the permanent-residence application from the applicant’s present authority to stay, work and travel. Then classify the new event as RED, AMBER or GREEN, preserve the source record, and take only the safe immediate step while the legal route is checked.
Build a one-page urgency sheet
| Priority | Trigger | Governing date | Evidence to preserve | Safe immediate step |
|---|---|---|---|---|
| RED | status expiry, refusal, removal or other irreversible risk | exact expiry, receipt or response date | visa, notice, decision, receipt and delivery proof | stop assumptions and obtain same-day or prompt advice |
| AMBER | material change, document contradiction, delayed external record or planned travel | filing, appointment, departure or document date | current application copy and primary records | pause the affected step and obtain written classification |
| GREEN | ordinary preparation gap or routine pending status without a new acute event | next review date | dependency register and official tracking | continue controlled preparation or documented monitoring |
Do not use colour alone. Write the event, date, evidence and person responsible for the next action.
RED: temporary status may expire or already be disputed
A permanent-residence application is not a temporary visa and does not itself authorise residence or work while Home Affairs considers it. Immigration Directive 7 of 2026 expressly says that its specified temporary measures do not apply to permanent-residence applicants and that they must keep their residential status valid.
Obtain urgent advice where:
- the current visa or other authority is close to expiry;
- the applicant may have worked, studied or conducted another activity outside the recorded conditions;
- a renewal or change application was refused or cannot be verified;
- an overstay, undesirability or prohibited-person issue appears in the record;
- an immigration official has issued a departure, detention, removal or compliance notice; or
- the person plans to rely on a permanent-residence receipt as proof of current status.
Preserve the visa, passport pages, entry and exit record, receipts, tracking evidence, decisions and the exact date each item was received. Do not travel, continue an uncertain activity or file a new explanation solely because a generic concession summary appears online.
RED: a refusal or adverse decision has been received
Once a refusal or other adverse decision is received, the problem is no longer ordinary preparation or delay. Section 8 of the Immigration Act contains internal review and appeal procedures, and short working-day periods may apply depending on who made the decision and when it was received.
Record:
- the decision-maker named in the notice;
- the date and method of receipt;
- the full reasons and every page of the decision;
- the exact submitted bundle and receipt;
- the internal route stated in the notice; and
- any mismatch between the decision and the category or evidence filed.
Do not spend the response period sending general tracking enquiries. Use the separate visa refusal and appeal preparation guide and obtain case-specific advice on the correct internal remedy, deadline, reasons and any court route.
RED: a filing or response deadline is imminent
Urgency may arise before initial submission where a status, document, appointment, family or employment event will change the facts. It may arise after submission where Home Affairs or VFS requests information by a fixed date.
Keep the request in its original form, note when it was received, and map each question to a primary record. Ask whether a partial response, extension request, correction or formal explanation is legally and operationally available. Do not send an invented placeholder, altered record or contradictory new bundle merely to meet the date.
RED: fraud, corruption or misrepresentation is alleged
Treat any allegation that a document, relationship, employment record, qualification, financial statement or answer is false as an urgent legal and evidence-preservation matter. Secure the original file, metadata, correspondence, payment trail, provider details and every version submitted.
Do not confront a suspected intermediary by deleting shared records or allowing remote access to the account. Do not create a replacement story. A lawyer may need to separate an applicant error, issuer problem, intermediary conduct and Home Affairs allegation before any response is made.
AMBER: a material fact has changed
A new passport, name, address, employer, role, relationship, dependant, financial position, business fact, criminal matter or travel plan may affect the application or the contact record. The correct response depends on the category, timing and current instructions.
Create a change note showing:
- the fact as originally recorded;
- the new fact and effective date;
- the primary evidence;
- the application fields or annexures affected;
- any previous statement that now needs explanation; and
- the proposed notification or correction route.
Pause any affected filing until the change is classified. Do not overwrite the original working file or submit a silent replacement page.
AMBER: travel or re-entry is planned
Permanent residence pending does not guarantee departure or re-entry rights. Before booking or travelling, verify the current visa, passport validity, visa-exemption position if relevant, conditions, pending temporary application, destination and return date.
Directive 7 of 2026 contains travel measures for defined waiver, long-term-visa and visa-appeal applicants with verifiable receipts, but it excludes permanent-residence applications. A person may have a separate temporary matter that falls within the directive; that must be tested on its own facts. The permanent-residence receipt is not a substitute.
AMBER: the application or a critical record cannot be traced
If VFS or Home Affairs cannot locate the reference, preserve the receipt, payment, submission location, passport used, complete bundle, courier or collection proof and dated tracking results. First determine whether the problem is a wrong reference, passport mismatch, uncaptured submission, missing file or non-delivery of an existing decision.
Send one precise written enquiry instead of repeated messages with different attachments. If the application was lodged and remains genuinely stalled, use the permanent-residence delay and legal-options guide to build the escalation record.
GREEN: ordinary preparation remains controlled
A matter is usually suitable for routine preparation where:
- the route is identified but evidence is still being collected;
- an external document is pending and no status or filing date is at risk;
- the applicant has a valid, understood temporary status;
- no adverse decision, allegation or material contradiction has appeared; and
- the file has a named owner and next review date.
GREEN does not mean approved or risk-free. Continue the document dependency register and move the item to AMBER or RED when the facts change.
The 2026 medical-report waiver is usually not an emergency
Under Ministerial Immigration Directive 10 of 2026, the prescribed medical report is generally no longer an item for a future or pending visa or permanent-residence application, so an outdated checklist entry alone is not an emergency. An older checklist that still asks for the medical report should be reconciled before filing or answering a request.
The directive does not itself approve the application, extend status or waive police-clearance, applicable yellow-fever vaccination, verification or category requirements. The radiological-report requirement had already been removed in 2024. Treat an express Home Affairs request, contradictory instruction or live deadline as a file-specific question rather than ignoring it.
What to send for urgent triage
Send a compact pack:
- one-sentence description of the new event;
- current location, status, conditions and expiry;
- the decision, notice, request or travel plan creating urgency;
- proof of the governing date and when it was received;
- the permanent-residence category and submission status;
- the exact application bundle, receipt and tracking evidence where already filed; and
- the immediate decision required from the lawyer.
Avoid sending passwords, original passports or unredacted sensitive records through an unverified channel.
FAQs
Does a pending permanent-residence application protect my temporary status?
No. A permanent-residence application is not a temporary visa, and Directive 7 of 2026 expressly excludes permanent-residence applicants from its specified concessions.
Is a long permanent-residence processing time automatically urgent?
No. Elapsed time must be assessed against the application record, official responses and prejudice. Use the separate delay guide unless a new status, refusal, travel, deadline or evidence event creates acute risk.
What should I do immediately after receiving a refusal?
Preserve the full decision, reasons, receipt date and submitted bundle, then obtain prompt advice. Section 8 internal routes can have short working-day periods measured from receipt.
Can I travel using only a permanent-residence receipt?
No. The receipt does not guarantee departure or re-entry rights. Verify the passport, current visa or other authority, conditions and any separate pending temporary application before travel.
