Quick answer
Before a substantive reply, check six things: the sender, the represented claimant, the debt and amount, the legal stage, the source of the deadline, and the reply or payment channel. Mark the response:
How to use this guide
- GO only for a narrow, verified purpose such as a neutral acknowledgement or focused information request.
- HOLD when a material identity, amount, prescription, authority or wording issue must be checked before a substantive answer.
- ESCALATE when court process, judgment, enforcement, an imminent date, a risky signature or suspected impersonation is involved.
HOLD does not mean ignore the matter. If a formal deadline may be running, the correct status is ESCALATE. This gate assumes you already preserved the original contact; use the proof checklist for the full evidence index.
Write the purpose of the reply first
Do not draft until you can complete this sentence:
“The only purpose of this response is to .”
Examples are acknowledging receipt, requesting identification of the claimant, seeking an account breakdown, disputing a specific entry, communicating through an authorised representative, or taking the formal step required by a court document.
If the purpose is “explain everything” or “make them stop”, the scope is too loose. A narrow purpose makes it easier to identify unnecessary admissions and sensitive information.
Check 1: verify the sender and regulator
Record the person’s name, firm or business, email domain, phone number, physical details and stated capacity. Obtain verification details independently rather than using only a link or phone number in the message.
For a purported attorney or legal practitioner, use the Legal Practice Council’s official practitioner search and independently sourced firm details. Remember that a search result can confirm professional enrolment information; it does not prove the debt, mandate, bank account or expertise.
Do not assume every person collecting a debt must be registered with the Council for Debt Collectors. The Debt Collectors Act definition excludes an attorney and an attorney’s employee from its ordinary definition of “debt collector”. That distinction also affects the correct complaint route.
GO: independently verified firm and contact channel.
HOLD: inconsistent domain, names or contact details, but no formal deadline identified.
ESCALATE: suspected impersonation combined with payment pressure, identity-data request or a live formal process.
Check 2: identify the claimant and legal capacity
The sender and claimant may be different. Record:
- the original creditor;
- the person or entity now said to claim;
- the account or agreement reference;
- whether a sale, cession, assignment, merger, mandate, suretyship or judgment is alleged; and
- the exact party named in any court document.
Ask only the focused question needed to resolve a mismatch. Do not state that the claim is invalid merely because ownership or authority is not yet clear. Equally, do not make payment to an unfamiliar party merely because a letter says the debt was transferred.
GO: claimant and capacity match the verified record sufficiently for the intended narrow reply.
HOLD: ordinary contact names a new claimant or reference that needs clarification.
ESCALATE: court papers name parties you do not recognise, or judgment or enforcement is alleged against the wrong person.
Check 3: identify the debt, account and amount
At minimum, distinguish:
- what transaction or order allegedly created the obligation;
- the principal amount said to remain;
- interest, fees, collection costs and legal costs as separately stated;
- payments, credits and reversals reflected; and
- the amount or component actually disputed.
Do not demand every conceivable document as a condition for all future action. The claimant’s procedural proof obligations depend on the claim and stage. Your pre-response goal is narrower: decide whether you understand the alleged account well enough to make the intended statement safely.
GO: a neutral acknowledgement or focused query that does not concede an unreconciled amount.
HOLD: balance, identity, allocation or prescription issue needs review before a merits response, payment or signature.
ESCALATE: a large or complex claim, material identity dispute, possible fraud, or formal paper requiring a defence or application.
Check 4: classify the communication
Do not reply to the subject line; classify the complete attachment or paper. Is it:
- an ordinary call, email or collection message;
- a letter of demand;
- a notice said to be under the National Credit Act;
- a summons or application;
- a judgment-related notice;
- a sheriff, attachment or sale document; or
- a settlement or acknowledgement proposal for signature?
A National Credit Act section 129 notice operates only where that Act and the relevant provisions apply. A summons requires a procedural response determined from the court, rules and service facts. A judgment or enforcement document may require advice about a later stage rather than a simple dispute letter.
Use the letter of demand and summons pages only for orientation.
GO: verified ordinary contact with no formal or irreversible event identified.
HOLD: ambiguous attachment or incomplete pages with enough time to verify.
ESCALATE: any possible summons, application, judgment, section 65A, warrant, writ, attachment or sale process.
Check 5: verify the deadline source
Copy every date, then label its source: sender request, contract, statute, court rule, court order or enforcement paper. Record service or receipt separately from the date printed.
Do not calculate a court last day from an old template. Magistrates’ Court service rules and forms changed during 2025 and 2026, so current Rules Board notices, the actual paper and the service facts matter. Do not assume that asking for documents, negotiating or filing a complaint extends anything.
GO: the reply is optional or ordinary and enough verified time remains.
HOLD: a private response date is unclear and can be checked without risking formal process.
ESCALATE: any unverified court, appearance, filing, enforcement or imminent date.
The deadline register provides the full date-control method.
Check 6: verify the reply and payment channel
Separate the communication channel from the bank-account verification. Confirm:
- the verified address for the intended recipient;
- whether a court document requires filing, service or delivery elsewhere;
- the method that will create reliable proof of delivery;
- who inside your household or business may authorise the content;
- whether attachments contain unrelated personal or financial data; and
- any payment beneficiary and bank details through a trusted independent route.
Do not send identity documents, bank statements or credentials merely because an unsolicited message requests them. Do not send a court response only to a call-centre inbox if the rules require another action. Do not let a changed-bank-detail message verify itself.
GO: recipient, purpose, content, channel and proof are verified.
HOLD: ordinary communication channel or privacy scope is uncertain.
ESCALATE: suspicious payment instructions, identity-theft risk or formal filing/service requirements.
Apply the GO / HOLD / ESCALATE decision
| Status | When it fits | What happens next |
|---|---|---|
| GO | All six checks support a narrow, reversible response | Send the authorised response and save proof |
| HOLD | A material fact or wording issue remains, with no formal deadline risk | Define the missing check, owner and completion time |
| ESCALATE | Formal process, irreversibility, imminent date or fraud concern exists | Obtain prompt legal or appropriate specialist help and protect the formal step |
One ESCALATE result overrides several GO results. For example, a verified law firm and correct account do not make a summons an ordinary email matter.
Keep a neutral response narrow
Where the gate supports a limited ordinary-contact response, it should contain only what the purpose requires. Depending on the facts, that may include the reference, acknowledgement of receipt, a focused identification or account query, a verified correspondence channel, and a request that material communications be in writing.
Do not assume that adding “without prejudice”, “rights reserved”, “no admission” or another label cures risky substance. Do not copy a template that denies facts you have not checked. Do not promise payment by a date you cannot meet.
This article deliberately does not provide a universal response template. The correct wording depends on whether the message is ordinary contact, a statutory notice, a court paper, a prescription-sensitive claim or a proposed settlement.
When to use HOLD correctly
A valid HOLD entry must name:
- the unresolved issue;
- why it matters to the reply;
- who will verify it;
- the latest safe verification time;
- the separate formal deadline check; and
- what action remains prohibited meanwhile.
For example: “HOLD substantive admission pending reconciliation of two payments; finance owner to supply entries by 14:00; lawyer separately checking summons service today; do not sign the proposed acknowledgement.”
An open-ended “wait and see” is not a controlled hold.
When ESCALATE does not mean panic
ESCALATE means the response should be owned by someone qualified to manage the identified risk. It does not mean the claim is valid, the matter will go to trial, or urgent court relief is automatically available.
The help could be a same-day deadline check, verification of an alleged judgment, advice on a proposed acknowledgement, fraud reporting, or a defined court response. Use the when-to-get-help guide to identify the type and speed of assistance.
Legal disclaimer
This is a general South African response-control framework, not a response template or advice on a particular claim. The correct recipient, wording, deadline, filing method, prescription position and payment decision depend on the complete record and current law. Obtain prompt advice on formal process or any irreversible act.
FAQs
What are the six checks before replying to debt attorneys?
Verify the sender, represented claimant, debt and amount, legal stage, source of the deadline, and the reply or payment channel. Then mark the proposed response GO, HOLD or ESCALATE.
Does HOLD mean I should ignore the contact?
No. HOLD means a defined issue must be checked before a substantive reply. If formal process or an imminent date may be involved, escalate promptly rather than waiting.
Can I send a neutral acknowledgement?
Only after the sender, purpose, stage, deadline and channel are checked. A neutral email must not be mistaken for the filing, service or appearance required by a court document.
Must every debt collector appear on the Council for Debt Collectors register?
No. The Debt Collectors Act definition distinguishes attorneys and their employees. Verify purported legal practitioners through the Legal Practice Council and identify the actor before choosing a regulator.
Do rights-reserved words make a reply safe?
Not by themselves. A label does not correct an admission, extend a deadline, protect an unsafe payment or make the wrong procedural response valid.
