1. Confirm that the Critical Skills route is the right route
Section 19(4) of the Immigration Act allows the Director-General, subject to prescribed requirements, to issue a work visa to a person with skills or qualifications determined by the Minister to be critical for South Africa. 2. Apply the current points-based rule correctly
The Third Amendment to the Immigration Regulations was gazetted on 9 October 2024. The points-based notice was then published on 18 October 2024, and Ministerial Immigration Directive 10 of 2024 states that applications, extensions, renewals and changes received after the notice must be adjudicated under the points-based system, subject to the transitional and special-dispensation qualifications in the directive.
The notice allocates points for:
- an occupation on the Critical Skills List: 100 points;
- qualifications at NQF levels 7 to 10: 30 or 50 points, depending on level;
- an employment offer within specified gross annual remuneration bands: 20 or 50 points;
- five or more years of work experience: 20 or 30 points;
- an offer from a Trusted Employer: 30 points; and
- proficiency in at least one official language: 10 points.
It then states two controlling rules. First, an offer of employment is mandatory. Second, an applicant must earn 100 points and satisfy all other prescribed requirements. A person who reaches 100 points through a listed occupation may be issued a Critical Skills Work Visa; a person who reaches the threshold through another combination may be issued a General Work Visa.
For a listed occupation, the occupation itself provides the threshold score. The salary, qualification, experience, trusted-employer and language categories can still be recorded on the required points form, but they do not replace the occupation match. Conversely, an impressive score assembled without a listed occupation does not create Critical Skills eligibility.

3. Build the qualification and SAQA evidence
Qualification documents
Collect the final award certificate and the complete academic record for every qualification relied upon. Include official translations where the issuing language and the receiving checklist require them. If names differ across the passport and qualification documents, prepare the lawful name-linking evidence rather than altering a document or relying on an unexplained affidavit.
The qualification must satisfy the minimum level and field reflected for the occupation. A degree title that resembles the listed discipline is not enough if the SAQA outcome places it below the stated NQF level or the subject content does not support the claimed occupation.
SAQA evaluation
SAQA explains that its foreign-qualification process first verifies the status and authenticity of the institution, qualification and award, and then compares the qualification with the South African NQF. A SAQA Certificate of Evaluation does not grant professional registration, confirm work experience or decide visa eligibility. It answers the separate qualification-recognition question.
SAQA's current system requires the qualification holder to lodge the foreign-evaluation application using their own unique contact details. The applicant should retain:
- the SAQA application or submission number;
- the signed application and consent material required by the portal;

4. Prepare professional-body and experience evidence
Regulation 18(5) distinguishes three related forms of proof:
- written confirmation from a SAQA-recognised professional body, council or board, or a relevant government department, confirming the applicant's skills or qualifications and appropriate post-qualification experience;
- proof of application for registration where registration is required by law; and
- the SAQA evaluation of a foreign qualification, subject to the limited waiver described above.
The Critical Skills List identifies the body associated with each occupation, but the exact process is set by that body. Membership, statutory registration, candidate status and a visa-support confirmation are not automatically the same document. Ask the body what it issues for this occupation and whether it will state:
- the occupation and OFO code assessed;
- the qualification reviewed;
- the professional status or registration category;
- the post-qualification experience accepted;
- any supervision or practice restriction; and
- the date and validity of the confirmation.
Experience letters should be verifiable and should identify the employer, role, dates, working arrangement and material duties. A reference that only says an applicant was “excellent” does not prove that the experience corresponds to the listed occupation. Where the points form also claims five or more years of experience, calculate the period from the same evidence and do not double-count overlapping jobs.

5. Document the employment offer and employer
The offer must be real, verifiable and consistent with the occupation claimed. The VFS page says it must come from an employer in good standing with the Department of Employment and Labour. The employment material should enable an adjudicator to compare the job with the list and verify the employer.
Prepare, as the applicable checklist requires:
- a signed offer or employment contract;
- the employer's registered name, registration number, physical address and contact details;
- the proposed position, duties and reporting line;
- work location and intended start date;
- remuneration stated on the same annual or monthly basis used in the points evidence;
- the employment duration and any visa-dependent commencement condition;
- the authorised signatory's name and role;
- employer undertakings required by the regulations or checklist; and
- Trusted Employer evidence only if that status is genuinely relied upon.
The job title, duties, salary and dates must agree across the offer, points form, professional confirmation, CV and motivation. If the role is described as one occupation to the professional body and another to Home Affairs, explain and correct the source documents before submission rather than adding a vague cover letter after the inconsistency exists.
Do not start work merely because an offer has been signed or an application has been lodged. The person's existing status, visa conditions and the approved work authorisation determine whether work is lawful.
6. Complete the personal and admissibility file
The submission location controls the exact form and presentation rules. An application abroad may use DHA-1738 and a mission-specific checklist; an eligible application or renewal submitted through a Visa Facilitation Centre in South Africa uses the current online process and generated documents. Do not copy a form from another country because its heading looks familiar.
The core file commonly includes:
- a passport valid for at least the period required by the current checklist, including the prescribed margin beyond the intended stay;
- copies of the passport data page and relevant previous visas or permits;
- photographs where the submission checklist requires them;
- the completed and signed application and points-based forms;
- a medical report no older than six months at submission;
