Quick answer
Get help quickly when there is immediate danger, arrest or detention, a protection concern, a court appearance, a document with a response date, an imminent eviction or seizure, a labour referral period, pressure to sign away rights, or a real risk that evidence or money will disappear.
Key takeaways
- Immediate safety comes before provider comparison.
- Put the controlling document and next date in the first sentence of every enquiry.
- Use matter-specific official routes while assistance eligibility is being assessed.
- Preserve evidence and originals without altering them.
- Limit any urgent mandate to a clear task and verify payment instructions.
- Reassess the longer-term affordable route after immediate risk is controlled.
How to use this guide
Use the appropriate emergency, court, police, commission or official process first where necessary. Then contact Legal Aid South Africa or another verified affordable-help route with a one-page urgent pack. Searching for free representation does not suspend a deadline, and “open now” does not prove that a practitioner has accepted the matter.
1. Immediate danger or an active crime
If someone is in immediate danger or a crime is occurring, use the current South African Police Service emergency channel, including 10111, rather than waiting for a legal-directory response. Move to safety where possible and preserve the reference or occurrence details.
Legal advice may still be needed, but it is not a substitute for emergency response. Do not post a victim's location, child information or confidential evidence publicly while looking for help.
2. Arrest, detention or a criminal appearance
Treat arrest, detention, a warrant, bail issue or an approaching criminal court appearance as urgent. Record the person's full name, location, police station, case number if known, alleged charge and next court. Do not coach a false account or destroy communications.
Legal Aid South Africa covers qualifying criminal assistance under its current rules, and criminal applicants may encounter Legal Aid personnel through the court process. Contact the official advice or office channel and state the custody or court details first.
3. Domestic violence and immediate protection
Immediate safety and protection-order routes should not wait for a practice-area comparison. The Department of Justice publishes the current domestic-violence application process and regulations, including court and prescribed electronic routes and provisions relevant outside ordinary hours.
Take the operative facts, identification available, prior order or case number, evidence of threats or harm, safe contact method and information about children or other vulnerable people. Use the verified court or emergency channel; a pending appointment with a lawyer is not a protection order.
4. Court papers or an instruction with a stated date
Urgency rises when a summons, notice, order, application, subpoena, hearing notice, warrant, appeal notice or demand requires filing, service, attendance or compliance by a stated date. Keep the complete document and proof of delivery.
Do not assume every printed date is calculated the same way. Courts, tribunals, contracts and statutes use different triggers and exceptions. Ask the correct service to identify the rule governing the actual paper.
The urgent legal-help search guide explains how to separate immediate routes from ordinary lawyer availability.
5. Eviction, home loss or essential services
An imminent eviction step, execution order, lockout, utility disconnection or loss of essential shelter can require prompt action, especially where children, older persons, disability or other vulnerability is involved. Preserve the lease or occupation basis, notices, court papers, payment records and household facts.
Do not sign a move-out agreement under pressure without understanding it. If an order already exists, say so. Contact the relevant court or official service and disclose the execution or hearing date while seeking affordable assistance.
6. Labour and CCMA timing
Dismissal and unfair-labour-practice disputes can have short referral periods. Current CCMA guidance states that unfair-dismissal referrals are generally due within 30 days and unfair-labour-practice referrals within 90 days, while the correct bargaining council or accredited body may have jurisdiction. Late referrals can require condonation.
Verify the correct body and trigger for the actual dispute. Do not wait for a lawyer appointment if the official referral step must be taken first. CCMA representation by legal practitioners is also stage- and dispute-dependent.
7. Pressure to sign, admit, resign, settle or pay
Pause when someone demands an immediate signature, admission, resignation, settlement, waiver, transfer or payment that may be difficult to reverse. Keep the proposed document and the communication creating pressure. Ask for time and written terms where safe and lawful.
Do not claim that every document has a cooling-off period. The immediate task is to identify the document, governing process and consequence before acting.
8. Evidence, money or assets may disappear
Seek prompt advice where CCTV may be overwritten, a device or account may be lost, funds are moving, property may be attached or transferred, a business record may be destroyed, or a witness may become unavailable.
Preserve lawfully. Keep original files, metadata, account records and chain-of-custody notes. Do not hack an account, trespass, intimidate a witness or secretly obtain material you are not entitled to access.
The evidence-pack guide provides a controlled preservation method after the immediate risk is identified.
9. Use a minimum urgent intake pack
Send only what is needed for rapid triage through the verified channel:
- a one-paragraph factual summary;
- the operative document;
- the forum, case or reference number;
- the next stated date;
- the immediate service requested;
- safe contact details; and
- any safety, custody or vulnerability information.
State that fuller eligibility and evidence records are available. Do not let a missing bank statement or perfect chronology conceal an immediate court or safety issue.
10. Contact affordable-help routes without losing the official step
Legal Aid South Africa publishes its current Advice Line, callback and office channels. Its eligibility and matter rules still apply, but the urgent facts should be disclosed immediately. An LPC pro bono application or clinic intake may take time and does not guarantee acceptance.
Use a direct forum where appropriate. Small Claims Court clerks assist with qualifying claims, Equality Court clerks assist with their process, the Office of the Family Advocate provides neutral help within its child-related mandate, and regulators or ombuds may have complaint routes. These services are not interchangeable and do not all provide a lawyer.
The assistance-route comparison helps identify the longer-term affordable option after the immediate step is protected.
11. Verify urgent private help
Urgency creates fraud risk. Verify a named practitioner through the Legal Practice Council. Confirm the official payment destination, the person responsible, the first task, the rate or amount, and whether any client money goes to a verified trust account with the required Fidelity Fund protection.
Limit the emergency mandate—for example, read one document, attend one appearance or prepare one filing—and require a new written decision before broader work or spending begins.
12. Reassess after the immediate risk
Once safety, attendance, filing or preservation is controlled, reassess eligibility, matter coverage, merits, capacity and the appropriate longer-term provider. The person who handled an urgent appearance may not be the right owner for every linked workstream.
Use the final free-help selection checklist for the ongoing decision. Keep the urgent handover record so no date or document disappears between providers.
FAQs
Does applying for Legal Aid stop a court or CCMA deadline?
No. Continue protecting the matter through the correct official process until a service expressly accepts responsibility for the date.
Should I wait for every eligibility document before reporting urgency?
No. Send the verified route the urgent core and disclose what is missing. Ask what immediate official step is required while screening continues.
Does “open now” mean a lawyer will take the case?
No. It may show only availability. Verify identity, scope, task acceptance, deadline ownership and payment instructions.
Is every dismissal referral due in 30 days?
No universal statement covers every employment dispute. Current CCMA guidance gives general periods for dismissal and unfair-labour-practice referrals, but jurisdiction, trigger, category and exceptions must be checked for the actual matter.
