Quick answer
Before booking an advertised free lawyer consultation, ask the provider to confirm the offer in writing. Establish who will conduct it, how long it lasts, whether documents are reviewed, whether legal advice is included, what issue can be discussed, what written output follows, and what triggers a fee. Also confirm confidentiality, conflict screening, cancellation terms and whether payment details or a deposit are required.
How to use this guide
A free consultation may be useful intake, a short suitability call, basic legal orientation or a substantive first meeting. Those are different products. The word “free” does not by itself mean free representation, free drafting, unlimited follow-up or that the practice will accept the matter.
Verify the provider before sharing the story
Ask for the full name of the attorney or advocate who would be responsible if the matter proceeds. Search that individual on the Legal Practice Council’s public register and compare the type, province and practising indication with the profile. If the first call is conducted by a paralegal, candidate practitioner, call-centre agent or consultant, require that role to be stated.
The Legal Practice Act regulates the South African profession, while the LPC Code of Conduct provides professional standards. Neither a directory badge nor a free-call advertisement establishes current status, experience or suitability for your facts.
Ask the practice to complete a conflict check before you disclose detailed confidential material. Supply the formal names of the other parties, related companies and key people only for that purpose. Do not send a complete court, medical, employment, family or financial file to several providers whose identities and secure channels have not been verified.
Send a seven-question booking message
Use these questions before selecting an appointment:
- Who will attend, and what is each person’s professional role?
- Is the whole session free, and exactly how many minutes are included?
- Will anyone read documents beforehand, and is that review included?
- Does the meeting include legal advice, or only intake and a later quote?
- Will I receive a written summary, checklist or proposed scope?
- What cancellation, rescheduling, overrun or follow-up fees can arise?
- If the matter is urgent, can the session identify and protect the immediate procedural step?
Keep the reply with the booking. If the terms change at the meeting, pause before authorising paid work. A practice can reasonably charge for services outside the offer, but the boundary should be visible before the work is done.
Do not provide card details simply because an online form calls the appointment free. Ask whether a refundable reservation, missed-appointment fee or verification hold applies. If banking details arrive unexpectedly or change, confirm them through a separately known contact.
Prepare a concise, safe consultation pack
Write one page with the parties, decisive events, exact dates, desired outcome, next formal date and steps already taken. Attach only the document that created the immediate problem: for example, the contract clause, summons, dismissal letter, order, demand, refusal, lease notice or transaction draft.
Use an index for additional records and ask which ones the provider wants. This protects time and privacy. Mask identity numbers, account details, children’s information and unrelated third-party data until full copies are genuinely required through a secure route.
Mark facts that are uncertain. A consultation is more useful when the lawyer knows what is alleged, what is documented and what is still unknown. Do not edit messages, backdate records or omit a damaging page; early advice depends on the real record.
Prepare three outcome questions rather than a long speech. Ask what legal issue should be classified first, which deadline or risk needs immediate action, and what evidence would materially change the advice. If the lawyer cannot answer within the free scope, request the price for a limited written assessment.
Do not let a free appointment consume a live deadline
Tell the firm at booking if court papers, a hearing, dismissal, arrest, eviction attempt, status expiry, refusal, sale signature or safety threat is involved. Send the page showing the date. Ask whether someone competent can review it before the appointment.
The firm’s calendar does not extend a statutory, contractual or court period. A free intake call is not a filed notice, referral, appeal, objection or application. If the next free slot falls after a possible cut-off, seek urgent scoped advice elsewhere while preserving the original appointment if still useful.
Ask for the date analysis in writing once paid advice begins. It should identify the triggering event, source document, applicable route and assumptions. Avoid providers who give one universal response period without reading the papers.
Distinguish free consultation from other free-help models
A private firm’s promotional consultation is an offer defined by that provider. Pro bono work is legal service supplied without the usual professional fee under its own acceptance and scope. Legal Aid South Africa is a statutory assistance provider that applies eligibility, means, matter and merit rules. None of these labels guarantees that a particular case will be taken.
If you cannot afford private work, ask whether the consultation will produce a referral to Legal Aid, a law clinic, pro bono service, ombud, Tribunal or other public route. Ask for the name of the organisation and the next formal action rather than a vague suggestion to “try legal aid.”
A lawyer should also say when the matter does not need a lawyer. A regulator, small-claims process, CCMA, Rental Housing Tribunal, Family Advocate or administrative service may offer a more direct route depending on the facts. Public routes have their own authority and requirements, so verify them through official information.
Evaluate the paid proposal after the session
The follow-on mandate should name the client, legal practice, responsible practitioner, specific first stage and exclusions. Compare whether the proposal includes review, research, written advice, correspondence, drafting, filing, service, negotiation or attendance. Do not compare hourly rates as if the deliverables were identical.
Request the fee basis, deposit treatment, billing unit, VAT, disbursements, travel, counsel, experts, correspondent work, termination and file return. Ask what event will require a revised estimate and who can approve it. Where funds will be held in trust, verify the receiving practice and whether the responsible principal must hold a current Fidelity Fund Certificate.
The Legal Practitioners’ Fidelity Fund certificate guidance helps with the categories to which that regime applies. It does not guarantee competent advice or success and does not mean every dissatisfaction is a covered theft claim.
Score the first interaction on identity, listening, issue classification, deadline awareness, candour, privacy and scope clarity. A promise of guaranteed victory, a demand for immediate full payment, refusal to name the practitioner or claims of special influence should outweigh the attraction of a free first call.
The best free consultation gives you a truthful boundary and a defensible next decision. It should not pressure you into an undefined mandate or make you believe that the whole legal matter is now protected.
Important limitation
An advertised free consultation does not preserve a right, confirm representation, include later work, establish Legal Aid eligibility or warrant any legal outcome.
FAQs
Can a lawyer call a sales intake a free consultation?
The label alone does not define the service, so ask whether the meeting is intake, legal advice, document review or a suitability and quotation discussion.
What should I disclose before a free legal consultation conflict check?
Provide the formal names needed to screen conflicts, but hold back the full sensitive file until the provider, role and secure channel are confirmed.
Does booking a free consultation protect a court deadline?
No. A booking is not a filing or formal response; flag the papers and date immediately and obtain timely scoped advice if necessary.
Is Legal Aid the same as a private lawyer’s free first meeting?
No. Legal Aid applies statutory eligibility and matter criteria, while a private consultation is a provider-defined offer that may end with a paid proposal.
