Quick answer
Start with the complete existing maintenance order and a clear comparison between the circumstances when it was made and the circumstances now. Add reliable proof of income, ordinary living expenses, the maintained person’s current needs, payments made or received, and the event said to justify the change. A lawyer needs that connected record to assess whether there may be “good cause” to ask the maintenance court to substitute or discharge the order.
How to use this guide
Do not wait for a perfect file if the existing order is already being breached, a hearing is approaching, a party has disappeared, or the proposed change affects essential food, housing, school or medical costs. Take what you have and identify what is missing. Most importantly, continue to treat the existing order as operative unless a competent court changes it; a discussion or private arrangement does not itself rewrite the order.
Put the governing order at the front
Bring a readable certified or court-issued copy of the current maintenance order, including every page, annexure and later variation. If the obligation forms part of a divorce order or settlement made an order of court, include that entire document rather than extracting one maintenance clause. Add the court name, case or reference number, the date of the order and any notices already received.
The exact wording matters. An order may separate a monthly amount from school fees, medical-scheme membership, uncovered healthcare, transport or annual increases. A summary typed from memory can hide a condition, payment date or allocation that changes the analysis. Mark unclear phrases for discussion, but do not write on the original court copy.
If the order cannot be found, bring enough identifying information for the lawyer or maintenance office to trace it. The Department of Justice’s published Form B is the complaint form for substitution or discharge of an existing maintenance order. Confirm the current form and local filing requirements with the relevant maintenance court because the correct court and supporting process can depend on who applies and where the earlier order was made.
Build a before-and-now comparison
Create a two-column schedule showing the material position at the date of the order and today. Use source documents beside each figure. The Maintenance Act does not make a variation automatic merely because somebody asks for one; the court enquires into whether good cause exists and considers the evidence.
For income and means, collect recent payslips, bank statements, tax material, benefit statements, employment letters and proof of other regular receipts. A self-employed person should add business accounts, invoices, management information and records explaining personal expenses paid by a business. If employment ended or hours changed, include the retrenchment letter, resignation record, new contract, job-search evidence or medical evidence that explains the change instead of presenting only a lower bank balance.
For expenditure, prepare a realistic monthly schedule with supporting accounts or receipts. Separate the maintained person’s needs from the applicant’s household spending, and identify shared costs and the method used to allocate them. School invoices, childcare, transport, clothing, food, housing, therapy, disability-related support, medical-aid contributions and uncovered treatment should be dated and grouped. Avoid inflating a category or omitting a contribution made directly by the other party; unexplained numbers weaken an otherwise genuine request.
Reconcile every maintenance payment
Prepare a chronological payment ledger covering the period relevant to the problem. Record the due date, amount due under the order, amount paid, date received, payment method and any difference. Match entries to bank statements, receipts, payroll deductions or court records. Keep once-off school or medical payments separate from the monthly obligation unless the order clearly treats them as substitutes.
Flag arrears rather than silently netting them against the future amount you want. A prospective application to change an order and a dispute about past non-payment raise different issues. A lawyer should be able to see whether enforcement, a variation request, or both may require attention. Do not assume that requesting a decrease suspends the existing amount, and do not assume that accepting a temporary short payment permanently waives the order.
Document the reason for seeking a change
Add a concise chronology of the event relied on: a sustained income change, altered educational or healthcare needs, a changed care arrangement affecting actual costs, or another material development. Include the source record for each date. A bare statement that maintenance is “unfair” does not show what has changed or how the proposed figure was calculated.
Where the issue concerns a child, retain birth certificates and records relevant to the child’s needs. The Children’s Act makes the child’s best interests paramount in matters concerning care, protection and well-being, and recognises maintenance as a parental responsibility. That does not turn a variation application into a contest over parental character. Keep observations factual and centred on needs, means and the practical effect on the child.
If care or contact is also disputed, bring the parenting plan or related order and a neutral care calendar. Use it to explain expense allocation, not as leverage. The Department of Justice expressly describes maintenance and contact as separate matters. Denial of contact is therefore not a safe reason to stop paying under a maintenance order, and non-payment is not a safe reason to block contact.
Add communications without curating the story
Export relevant emails, messages and letters with dates and participants visible. Preserve proposals, responses, admissions and proof that documents were requested. Include communications that do not favour your position; selective disclosure can produce poor advice and later credibility problems. Keep the original electronic records and create working copies for annotation.
Write a one-page missing-record list. It might identify an unavailable court file, undisclosed business income, a missing school quotation or payments made in cash. Tell the lawyer what efforts have already been made to obtain each item. The maintenance officer has statutory investigation functions, so an evidence gap does not necessarily mean the matter cannot start, but it should be recognised rather than filled with guesswork.
Prepare the consultation handover
Arrange the pack in six sections: order and court papers; identity and relationship records; before-and-now financial comparison; needs and expenditure; payment history; and communications or change evidence. Number the pages and keep a clean digital copy. Finish with a short note stating the change requested, why it is said to be justified, what remains disputed and whether there is any current default or scheduled appearance.
Ask the lawyer to identify the proper court, whether the matter is a substitution or discharge complaint rather than another procedure, what evidence is still needed, and how the current order should be followed while the request is pending. No document pack guarantees a variation. Its purpose is to make the first advice accurate, reduce avoidable follow-up and expose urgent enforcement or child-welfare issues early.
Important limitation
This is general South African legal information, not advice on your order. Court, jurisdiction, arrears, safety and child-specific facts require individual assessment.
FAQs
Which court document matters most at a maintenance-change consultation?
Bring the complete operative order, including annexures and every later variation. If maintenance appears in a divorce order, include that entire order and its case details.
How should I show that my finances have changed since the order?
Pair a before-and-now schedule with reliable source records such as payslips, bank statements, tax material, employment records and proof of reasonable expenses.
Should maintenance arrears be included in the document pack?
Yes. Prepare a due-and-paid ledger with supporting records. Arrears and a future variation may require different steps, so do not silently offset one against the other.
Can I consult before every maintenance record is available?
Yes. Take the available file and a precise missing-record list, especially if default, essential needs or a court appearance makes early advice important.
