Quick answer
Speak to a lawyer before lodging when prescription, driver identification, claimant authority, form validity or an earlier submission is uncertain. Obtain advice promptly after a return, objection or non-acknowledgement, and before major expert spend or settlement where serious injury, future care, earnings loss, death or a represented claimant is involved.
How to use this guide
The RAF provides a direct-claim route, so representation is not compulsory for every claimant. The choice should follow legal and evidential risk, not a promise of faster payment.
Escalate prescription uncertainty immediately
For an ordinary adult claimant, treat the rules separately: where either driver or owner is identified, lodgement is ordinarily within three years from the cause-of-action date; where neither identity can be established, the Regulations ordinarily provide two years; and after timeous lodgement section 23(3) ordinarily measures five years from the cause-of-action date. Section 23(2) and current case law can affect minors and other legal disabilities, so ask for a claimant-specific calculation rather than adding five years to lodgement.
Do not delay this advice for a complete medical prognosis, police docket or expert report. Deadline protection and merits development can proceed on parallel tracks.
Get help where claimant authority is complex
A child, adult without capacity, deceased estate or dependant may require specific documents and legal standing. A family member should not sign, settle or receive money merely because they manage the paperwork.
Ask who is the proper claimant, which appointment or relationship evidence is needed and how changing capacity affects decisions. Preserve identity, birth, guardianship, curatorship, estate, marriage, maintenance and dependency records relevant to the particular claim.
Seek review of a disputed submission
If the RAF returns a form, objects to validity, requests extensive material or does not acknowledge delivery, keep the exact signed pack, index, proof of delivery and response. Do not discard the first attempt or assume resubmission automatically preserves its date.
A lawyer can classify the objection, current form position and available procedural response. That review may be more urgent than gathering another general bundle of documents.
Use advice for serious injury and expert strategy
RAF 4 is a separate serious-injury assessment process for general damages, not a report required for every loss category. Long-term impairment, future treatment, care or disputed causation can require several expert disciplines, each answering a defined question.
Obtain a staged plan before commissioning reports. A lawyer should not promise that an injury qualifies as serious or that an independent expert will support the allegation.
Escalate substantial or unusual financial loss
Self-employment, variable earnings, career interruption, future incapacity and loss of support need source financial records and reasoned assumptions. The statutory cap changes through official notices and must be applied at the relevant date.
Ask who builds the baseline, selects vocational or actuarial evidence and controls disbursements. A large claimed number is not a substitute for the chain from injury to supported financial loss.
Review settlement and release terms
Before accepting, identify the heads and period covered, apportionment, future treatment or undertaking, serious-injury position, earnings components, fees, costs and release wording. A gross amount should not be compared with out-of-pocket loss alone.
Direct claimants can seek legal advice for the settlement decision without necessarily authorising an entire lawsuit. Representation does not guarantee a better offer, but the scope of the release should be understood before signature.
Choose a verifiable, controlled mandate
Verify the practitioner through the Legal Practice Council and ask whether the practitioner is required to hold a Fidelity Fund Certificate; if so, confirm that it is current. Also ask who handles the file, what the first phase delivers, how original records are protected, when experts or counsel may be appointed and which costs require approval.
If a contingency fee is proposed, obtain the statutory written agreement and understand disbursements and settlement accounting. Do not transfer money or originals in response to guaranteed-outcome marketing.
Prepare the first-call control sheet
Include identity and authority, accident date, known or unknown driver details, police reference, treatment, work and expense effects, current form status, prior submissions, RAF correspondence and earliest possible deadline. Mark missing facts and name their likely source.
Ask the lawyer to answer the immediate risk first. A bounded prescription, validity or settlement review can be more proportionate than automatically authorising all later claim stages.
Also disclose any workplace accident, Compensation Fund process, private insurance, medical-scheme recovery or related claim. These facts do not automatically exclude RAF compensation, but overlapping records, benefits and legal routes may need coordination. A lawyer should identify the distinct tests and avoid inconsistent descriptions of the same injuries, work absence or payments across different proceedings.
What legal advice cannot guarantee
A lawyer can classify risk, control evidence and explain choices, but cannot guarantee negligent driving, valid lodgement, serious-injury status, expert support, compensation or timing. Legal assistance also cannot always repair an expired period. This guide is general information, not a deadline calculation or advice for a particular claim.
FAQs
Should I speak to a lawyer before completing RAF 1?
Seek advice first if the deadline, driver status, claimant capacity, earlier submission or correct form is uncertain. A straightforward claimant may also use the RAF’s direct route.
When is a rejected lodgement urgent?
Immediately preserve the exact pack, delivery proof and rejection or non-acknowledgement, then obtain advice on validity, correction and prescription.
Does serious injury always require representation?
Not automatically, but the RAF 4 process, long-term consequences and expert evidence can make early legal guidance valuable.
Can a lawyer guarantee an offer will improve?
No. Advice can clarify evidence, rights and release terms, but cannot guarantee a different amount or outcome.
