Quick answer
A bail matter needs same-day attention when the accused's custody location or court date is unknown, the first appearance is imminent or may have been missed, a serious charge may trigger a higher statutory burden, or there is an immediate medical, safety, interpreter or child-related concern. It is also urgent when police request a statement, a witness makes contact, evidence may disappear, or the family is about to offer false or impractical information.
How to use this guide
Urgent does not mean guaranteed release. It means that custody, representation, evidence and court controls must be stabilised before delay causes avoidable harm.
Red: get same-day help
1. The accused cannot be located
Confirm the police station, correctional facility, investigating officer and court route. Record who last saw the accused, when, and what official source was checked. Do not rely only on family rumours.
The Constitution and section 50 of the Criminal Procedure Act regulate bringing an arrested person before court. Section 50's ordinary ceiling is 48 hours, but its court-day and other statutory qualifications must be applied to the actual arrest timeline. A lawyer should calculate the deadline from the actual arrest and court calendar.
Use the arrest-rights first-steps checklist immediately.
2. The court appearance is today, tomorrow or unclear
Send the arrest or court papers to the lawyer at once. Confirm the court, date, time, custody transport and whether representation has been arranged. A bail application may be raised at the first appearance, but the hearing may be postponed for up to seven days at a time on statutory grounds such as insufficient information or the need to secure material evidence.
Do not promise the family that bail will be decided at the first appearance. Prepare for both a hearing and a lawful postponement.
3. The charge may fall under Schedule 5 or Schedule 6
The legal burden changes in these matters. A Schedule 5 accused must adduce evidence satisfying the court that the interests of justice permit release. A Schedule 6 accused must establish exceptional circumstances which, in the interests of justice, permit release.
Do not classify the Schedule from the allegation's popular name. The exact charge and qualifying facts must be checked. Send every official charge-related document immediately.
4. There is an urgent health, medication or safety risk
Act immediately where the accused needs essential medication, has an injury, disability, mental-health crisis, withdrawal risk, pregnancy-related need, interpreter requirement or credible safety concern. Record the condition, medication, treating practitioner, custody location, requests already made and the facility's response.
Seek health intervention for the health need itself. Do not wait to use the problem as a bail argument.
5. A child is detained or another vulnerable person is involved
Children in criminal matters have additional constitutional and statutory protections and automatically qualify for Legal Aid without a means test. Contact Legal Aid or a suitable lawyer promptly and identify the guardian, age, custody location, court and immediate welfare needs.
Do not apply adult bail assumptions to a child.
6. Police request a further statement, device or evidence
Record who made the request, when, what was requested and any stated authority or deadline. The accused has rights to silence and legal representation, but must not lie, obstruct or destroy evidence.
Get advice before providing a detailed statement or signing something not understood. Do not resist a lawful warrant or order.
7. The complainant or a witness contacts the accused or family
Do not engage about the case. Preserve the full incoming message or call details and send them to the lawyer. Direct or indirect contact may create safety, witness-interference, protection-order or bail-risk issues even when the other person initiated it.
8. Relevant evidence may be overwritten or lost
Tell the lawyer if CCTV, access records, location history, messages, workplace logs or medical records may disappear. Preserve what is lawfully available in original form. Do not access another person's account or coach a witness.
Amber: act promptly, before the hearing
The proposed address is unstable or conflicts with a restriction
If the accused cannot lawfully live at the proposed address, a complainant or witness lives nearby, or the occupier has not agreed, identify an honest alternative. Do not manufacture address proof.
Work, study or caregiving proof is incomplete
Ask the employer, institution or lawful caregiver for factual verification. Do not dictate praise or supervision promises. Give the lawyer the available records and identify gaps.
Prior matters, passports or orders are uncertain
Previous convictions, pending charges, other bail, protection orders and correctional status may require disclosure. Passports and travel means can be relevant to flight risk. Tell the lawyer about uncertainty before court rather than waiting for cross-examination.
The available bail amount is limited
State the true amount and source. If the court finds release permissible and considers money, section 60(2B) requires an affordability inquiry. Do not use unofficial intermediaries or assume a larger amount guarantees release.
No lawyer has confirmed attendance
Clarify whether a private lawyer is formally instructed or whether Legal Aid has accepted the request. A message to a receptionist is not the same as confirmed representation. Retain the reference, scope and court-arrival instruction.
The bail-application service page and criminal-law hub identify the relevant category.
Green: important preparation that is not presently an emergency
Where custody, court, health, representation and evidence are controlled, continue with:
- indexed identity and official papers;
- genuine residence evidence;
- work or study verification;
- dependant and health records;
- accurate travel and prior-matter information;
- affordable bail-fund evidence;
- practical proposed conditions; and
- a clean handover to the lawyer.
“Green” does not mean optional. It means the task can follow a controlled preparation sequence rather than an emergency response.
The criminal-charge preparation checklist, criminal-court preparation pack and full bail-hearing documents guide support that work.
What the lawyer needs in an urgent message
Use one concise message:
- accused person's name and identity;
- current custody location;
- arrest date and time;
- court and next date;
- exact charge or best official description;
- case reference;
- urgent health, safety or interpreter issue;
- police, witness or evidence event requiring action; and
- your reliable contact details.
Attach the clearest official paper. Do not send dozens of unlabelled screenshots before the controls are understood.
What not to do during an urgent bail problem
- Do not pay someone promising influence.
- Do not contact the complainant or witnesses.
- Do not create address, work or medical proof.
- Do not hide a passport, prior case or order.
- Do not publish the defence online.
- Do not draft a detailed affidavit without advice.
- Do not assume a postponement means the case is lost.
- Do not promise a condition the accused cannot follow.
Urgency should improve accuracy and lawful control, not produce panic-driven conduct.
FAQs
Is every Schedule 6 bail matter automatically refused?
No. The accused faces the statutory exceptional-circumstances burden, but the court must decide the evidence under the applicable law. It is urgent to obtain informed preparation, not to assume the result.
Is a first appearance always a completed bail hearing?
No. Bail may be raised, but the court may postpone proceedings on statutory grounds. Record the new date, custody position and information required.
What if medication is being withheld?
Record the medication, prescription, facility, requests and response; seek immediate health assistance and tell the lawyer or Legal Aid. Do not wait for the bail hearing.
Is witness contact urgent if the witness contacted us first?
Yes. Preserve the contact and obtain advice before responding. The source of the first message does not automatically remove condition, safety or interference risk.
