Quick answer
Prepare documents in five folders: estate authority, distribution route, property and bond, people and capacity, and money and clearances. Include the death notice or certificate, Master reference, executor appointment, accepted will, inventory and estate-account status; the title information and bond; any sale or redistribution agreement; beneficiary and representative records; and tax, municipal, levy, insurance, valuation, cost and payment evidence.
How to use this guide
Index each item by issuer, date, version and status. A lawyer should be able to see both what exists and which formal document is still missing.
Estate reporting and appointment
Bring the death certificate or reporting evidence, Master's reference, inventory supplied to the Master and the letter of executorship or authority. Add any later amendment, removal, substitution, restriction or court direction affecting the representative.
Identify the person who currently instructs professionals. If a family member has been coordinating the property but is not the appointed representative, record that fact rather than presenting informal coordination as legal authority.
Will and beneficiary records
Provide the will accepted in the administration process and any codicil, interpretation issue or relevant court order. Include a beneficiary schedule with names, identity details, contact information, relationship to the deceased and the interest claimed under the account.
Where intestate succession, renunciation, representation, a minor, trust or deceased beneficiary affects the route, add the source record establishing it. Do not prepare a home-made “family consent” as a substitute for professional advice on the required authority.
Liquidation and distribution account
Bring the current liquidation and distribution account or record its status if not yet available. Add the inspection notice, objections, Master's queries, amendments and proof that the account may be implemented where applicable.
Highlight the property entry, valuation, liabilities, allocation and person entitled to the asset or proceeds. The account is central to understanding why the proposed registration route has been chosen.
Preserve the estate decision history
Add correspondence that explains how the current route was selected: instructions from the executor, Master’s queries or directions, beneficiary communications, professional advice, proposed redistributions and objections. Label proposals and superseded drafts clearly. A later family consensus should not be filed as though it were the account or formal authority under which transfer will occur.
Create a version register for the will, appointment, inventory and liquidation and distribution account. Record issuer, date, status and the event that replaced an earlier version. If the property allocation changed, identify the supporting estate step rather than asking the conveyancer to infer the reason from scattered emails.
Where a beneficiary, executor or other representative signs through a particular capacity, include the source document establishing that capacity. Leave an explicit gap note if the authority is still being obtained.
Property and bond file
Collect the title deed or deeds search, exact property description, mortgage-bond information, rates account, levy statement for a sectional unit, insurance details, leases and material title conditions. Include photographs or reports only where they relate to condition, occupation, valuation or a dispute.
Add occupation and preservation records
Prepare the lease or other occupation basis, key and access record, rent ledger, utility arrangements, insurance policy, condition evidence and invoices for necessary maintenance or security. Identify who authorised work and whether the estate, occupier or another person paid it. These documents help separate property preservation from an unresolved occupation or reimbursement dispute.
If rent was collected after death, include statements showing the receiving account and how the executor dealt with the income. Do not route future property money through an informal family account while the estate authority is being clarified.
Record any threatened cancellation of insurance, disconnection, deterioration or access problem in the consultation note. Urgent protection of an estate asset may require attention before the final transfer pack is complete.
The property transfer guide places these records within ordinary registration. If the original title is lost or a property description conflicts, flag the issue before the deed pack is prepared.
Route-specific agreements
For a sale, include the complete signed agreement, addenda, deposit, finance, guarantees and estate-agent mandate. For a distribution, include the account and beneficiary evidence. For a redistribution, preserve the professionally prepared agreement and required consents or approvals.
Do not merge these categories. A buyer's transfer-duty record is not evidence that an heir distribution attracts the same treatment, and an executor appointment is not itself a sale agreement.
Identity, capacity and compliance
Prepare the identity, address, marital-status, entity, trust, representative and beneficial-ownership records requested for each relevant party. Use the appointed firm's secure channel and record delivery. Avoid circulating sensitive packs to a broad family group.
The conveyancing glossary explains why deeds identity and capacity must align with the registration documents. Resolve differences in names, identity numbers or legal capacity early.
Tax, clearance and cost evidence
Include transfer-duty or exemption records, tax correspondence, municipal clearance figures, levy figures, bond-cancellation amounts, valuations, professional estimates and payment requests. Add proof of estate funds or authorised contributions and preserve final reconciliations.
Use the property transfer checklist as an index for the conveyancing lane. The lawyer directory can support separate estate, property, tax or dispute provider discovery where roles need to be divided.
Prepare a consultation note
Write the intended transfer route, current estate stage, next known deadline, main uncertainty and result required. List missing documents and who is believed to hold each one. Keep assumptions visibly labelled.
Add a responsibility map naming the executor or representative, estate practitioner, conveyancer, bond-cancellation firm, tax adviser and dispute lawyer where applicable. State what each person has actually been instructed to do. This prevents the same document being requested repeatedly while a necessary task is assumed to belong to someone else.
The purpose of the pack is not to overwhelm the lawyer. It is to prove authority, connect the property to the estate account, identify the chosen route and make unresolved title, beneficiary, tax or funding issues visible before they delay the registration work.
FAQs
Should I bring only the will?
No. The will is one part of the authority chain. Bring the death and Master records, appointment, estate account status, title, route documents, party records and cost or clearance information.
What if the original title deed cannot be found?
Tell the conveyancer immediately and provide the available title particulars and search results. Replacement or registry steps are formal and should not be improvised.
Do beneficiaries need identity and marital-status documents?
The relevant parties' current identity, status and capacity records are commonly needed for deeds and compliance work. Obtain the appointed professional's secure, transaction-specific list.
Should family WhatsApp messages be included?
Preserve material messages in original form if they record authority, agreement, objection or occupation facts, but do not substitute informal messages for the documents the estate process legally requires.
