Quick answer
South Africa's permanent SARS Voluntary Disclosure Programme does not give every applicant one generic countdown. The urgent timing question is usually whether SARS has already notified the person of the commencement of an audit or criminal investigation related to the default, because that can affect whether an application is voluntary. A limited statutory exception may be considered by a senior SARS official, so even that issue should not be reduced to an absolute slogan.
How to use this guide
At the same time, list every separate return, information-request, assessment, objection, appeal, payment and collection date. Preparing or submitting a VDP01 application should not be assumed to suspend those processes. The safest pre-filing review combines an eligibility check, a notice chronology, a complete tax-period schedule and a parallel-deadline register.
Identify the “deadline” you are worried about
Start by naming the document or event that creates urgency. Is there an audit commencement notice, criminal-investigation notice, verification request, request for relevant material, outstanding-return date, assessment, objection outcome, demand for payment or collection communication? Record its title, scope, tax type, period, date issued, date delivered, case number and response date.
Do not call all of these the VDP deadline. A return date is not an objection period; an assessment payment date is not the test for voluntariness; and an audit notice may affect eligibility without cancelling an unrelated procedural duty. Build a separate row for each date, identify its legal or documentary trigger and name the person responsible for it.
Check the audit and investigation chronology first
Gather all SARS letters, eFiling messages, emails, calls recorded in case notes and notices concerning audits, investigations, verifications or information requests. Read their exact scope. The relevant question is not merely whether SARS has ever contacted the taxpayer, but whether notice of commencement of an audit or criminal investigation has been given and whether it relates to the default proposed for disclosure.
Under the Tax Administration Act's VDP framework and SARS guidance, an application ordinarily needs to be voluntary. SARS explains that an application made after the relevant commencement notice is generally not voluntary. However, a senior SARS official may in defined circumstances treat it as voluntary, including statutory considerations about whether the default would otherwise have been detected and sound tax administration. Do not promise that the exception will be used, and do not file a partial account in the hope that the notice can be ignored.
If the chronology is unclear or a notice has already arrived, early advice is important. Preserve the original message and delivery evidence rather than relying on memory of a call.
Test the other VDP requirements
Timing alone does not make an application valid. Create an eligibility table against the statutory requirements. The disclosure must be voluntary; involve a default that has not occurred within five years of the disclosure of a similar default by the applicant or a person referred to in section 226(3); be full and complete in all material respects; involve behaviour referred to in column 2 of the understatement-penalty table in section 223; not result in a refund; and be made in the prescribed form and manner.
Check the applicant identity and authority, all affected tax types and periods, the default for each period, how it arose, the tax calculation, interest and penalties, and whether any previous VDP application concerns a similar default. Customs and excise defaults fall outside this TAA VDP programme and require their own legal framework.
Do not describe uncertainty as completeness. Maintain a gap register for missing returns, accounts, bank records, payroll files, invoices, contracts or prior adviser working papers. A disclosure limited to the easiest periods or transactions may not satisfy the full-and-complete requirement.
Separate VDP from objections and ordinary corrections
VDP addresses qualifying undisclosed defaults. It is not a substitute for objecting to an assessment merely because the taxpayer disagrees with SARS's interpretation or calculation. Nor is an objection a substitute for disclosing omitted income or another default. A request for correction, request for reasons, objection, appeal, remission application, complaint and VDP application each has a different function.
If an assessment already exists, identify whether it covers the proposed default and whether any dispute right is live. Calculate any objection period from the actual assessment, any valid reasons process and the current dispute rules. Do not assume VDP preparation preserves that period or that an objection protects VDP eligibility.
Build a parallel-deadline register
Use one row for each open process and include the trigger, due date, current status, required filing, owner and proof of completion. It may contain:
- outstanding returns or reconciliations;
- verification, audit or information-request responses;
- assessment reasons, objections or appeals;
- tax payments, statements of account and collection steps;
- provisional-tax or payroll dates; and
- company, trust or accounting records needed for the VDP calculation.
Confirm each period from the current notice, guide or rule. Do not apply a single business-day count to the whole register. If two processes may conflict, obtain advice on whether a protective filing, extension request, payment-suspension request or another step is available. Availability and approval must not be assumed.
Prepare a filing-ready VDP record
SARS uses the VDP01 process through eFiling, with operational handling described in its current guides. Prepare a tax-period matrix showing the original position, correct position, difference, tax, interest and relevant penalty treatment. Connect every figure to source records and preserve the method used.
Keep the application narrative consistent with the calculations and documentary chronology. Identify prior SARS contact accurately. Save the exact VDP01 submission, attachments, acknowledgement, case number and subsequent correspondence. A draft, screenshot or adviser email saying “filed” is not equivalent to SARS submission proof.
Relief arises only through the statutory process and VDP agreement. Do not promise that SARS will accept the application, waive every amount, refrain from all action or agree to instalments. The programme may provide specified relief for a valid disclosure, but tax and interest treatment, the agreement, assessment and payment terms remain fact-specific.
Decide when urgency needs professional review
Seek prompt tax-law advice where an audit or investigation notice may relate to the default, an assessment or objection date is running, collection has started, multiple taxpayers or periods are involved, records are incomplete, the conduct may have criminal implications, or the proposed disclosure could conflict with prior submissions.
The useful output is not a guessed final day. It is a written eligibility view, notice chronology, complete-period schedule, parallel-deadline register, evidence-gap list and filing plan that states what remains uncertain.
FAQs
Is there one universal SARS VDP filing deadline?
No single generic countdown safely describes every case. Check audit or investigation notices that may affect voluntariness and separately record every return, dispute, payment and information-request date.
Does any SARS contact make a VDP application non-voluntary?
Not every contact has the same effect. Examine whether SARS gave notice of commencement of an audit or criminal investigation related to the default, and obtain advice on the limited statutory exception where relevant.
Will submitting VDP01 pause an assessment objection deadline?
Do not assume so. VDP, objections, appeals, information requests, payment and collection are separate processes. Preserve and manage each trigger-based date independently.
What should be ready before a voluntary disclosure is filed?
Prepare an eligibility table, notice chronology, complete tax-period matrix, reconciled calculations, evidence index, gap list, parallel-deadline register and proof-of-filing plan.
