Do not state that every category belongs to the client or is immediately deliverable without advice. Instead, identify each item, who created or supplied it, whether it is an original, whether it has already been filed or served, why it is needed and what the firm says about it. That gives the parties and any later decision-maker a precise dispute to assess.
The request should also cover format. A scanned bundle without filenames, an unexplained download, an inaccessible case-management export or loose paper delivered without an index may not provide a usable handover. Ask for native electronic files where appropriate, readable copies, a folder structure or index, and a transfer record showing what was delivered and when.
Send a precise written handover request
Use the name and reference from the mandate, invoice or recent correspondence. A useful request should state:
- the client’s full name and authority to request the records;
- the matter name, case number and firm reference;
- whether the mandate has ended or a change of representative is proposed;
- the urgent documents required first and the reason for the deadline;
- the complete categories requested for later handover;
- the secure delivery address or collection arrangement;
- whether originals, copies or both are requested;
- a request for the file index and final or current itemised account;
- a request for the amount, basis and document scope of any asserted lien; and
- a reasonable response time linked to the actual urgency.
If a company, trust, estate, minor, represented adult, insurer or multiple clients are involved, authority may need to be proved. Do not pay, admit liability, give security or accept an undertaking merely to end the conversation without understanding its effect. Firm-level escalation
Send the indexed request to the responsible attorney and, where appropriate, the supervising partner, director or complaints contact. Ask for a written position on delivery, the account and any lien. This can narrow the dispute quickly and creates a reliable record.

The Legal Practice Council accepts complaints from members of the public through its current provincial forms and online process.
