Quick answer
Do not submit until a named reviewer has marked every material gate PASS, BLOCK or NOT APPLICABLE. The final check must confirm the route and current law, independently recalculate any points from the frozen evidence, reconcile the employer, role, remuneration and worker identity, apply waivers only within their terms, verify the receiving channel and record what the worker may lawfully do while the matter is pending.
How to use this guide
A complete-looking upload is not ready if one central fact is still contradictory. A BLOCK protects the file: it sends the exact issue to an owner with a resolution date. This page owns the single final release decision. Use the document-delay tracker to repair a block and the employer preparation guide to build the underlying file.
Gate 1: route and legal version
Record:
- proposed visa category;
- the actual work and employer relationship supporting it;
- Immigration Act section and regulation;
- current Gazette, directive, list or waiver used;
- date each source was checked; and
- any transition or special-dispensation rule relied on.
Mark BLOCK if the file uses “employer sponsorship” as the category, if the role could fall within materially different routes, or if the checklist source predates a relevant amendment without reconciliation.
The Third Amendment of the Immigration Regulations took effect in October 2024 and requires general and critical-skills work-visa applications to be adjudicated in accordance with the points-based system determined by the Minister. The current points notice is the replacement notice dated 18 October 2024, not the earlier withdrawn notice.
Gate 2: points applicability and transition
For a general or critical-skills application, confirm whether the points system applies to this submission. The 2024 implementation directive contains transition treatment for specified pending applications and appointments and a special rule for identified exemption-permit holders.
The gate should state:
- PASS: points system or a documented transition rule is identified from current authority;
- BLOCK: the team is relying only on when preparation started or on an undated checklist; or
- NOT APPLICABLE: another route is selected and the reason is recorded.
Do not choose the transition answer because it produces a more convenient document list.
Gate 3: independent points recalculation
Recalculate from the final evidence, not from the draft worksheet. The published points criteria cover occupation, qualifications, a mandatory offer of employment, salary, work experience, Trusted Employer status and language ability.
For every awarded point, record:
| Criterion | Final source file | Verified fact | Points claimed | Reviewer |
|---|---|---|---|---|
| Occupation | Current critical-skills list entry and role | Exact match or no match | Value from current notice | Name/date |
| Qualification | Certificate and applicable evaluation | NQF level supported | Value from current notice | Name/date |
| Offer and remuneration | Signed offer and salary schedule | Mandatory offer and band supported | Value from current notice | Name/date |
| Experience | Dated references | Eligible period supported | Value from current notice | Name/date |
| Trusted Employer | Formal current recognition | Correct employer entity | Value from current notice | Name/date |
Mark BLOCK where a total depends on an assumed NQF level, unverified scheme status, generic CV statement, mismatched salary or job title rather than real duties. Recheck the Gazette figures immediately before release because ministerial points can be changed by notice.
Gate 4: mandatory offer, role and salary alignment
Compare the final:
- offer or contract;
- job description;
- points worksheet;
- application form;
- employer resolution or authority;
- organisation chart where relevant; and
- actual operational plan.
Names, entity, title, duties, work location, duration, remuneration and intended start must agree or carry a truthful dated explanation. Confirm that any start is conditional on the required work authority.
Mark BLOCK if the business plans different work from the application, if a group company is substituted without explanation, or if remuneration is represented differently to reach a points band.
Gate 5: employer identity and undertakings
Confirm the legal employer and authorised signatory. Check the corporate particulars, operating address, contact details and any route-specific registrations or undertakings. For a transfer, reconcile the foreign and South African entities and the worker's prior relationship.
Where Trusted Employer status is relied on, verify current formal recognition for the offering entity. An expression of interest, application, invitation or group-company recognition is not automatically accreditation.
Record who will monitor visa and passport expiry, retain prescribed records and report termination or a status breach. Submission does not end the employer's section 38 duties.
Gate 6: worker identity and status
Match the final form to the original passport and complete relevant history:
- names and date of birth;
- current and old passport numbers;
- nationality and current residence;
- visa or exemption type and conditions;
- entries, departures and expiry;
- previous applications and decisions;
- refusals, appeals and waivers; and
- current employer, activity and work location.
Mark BLOCK if an old passport containing the status record is missing, a prior refusal is unexplained, or the employer cannot state what authorises the worker's present activity. Do not treat an application receipt as a visa.
Gate 7: general-work and SAQA waiver
If this is a general work visa under the points system, record whether the October 2024 waiver applies. It waived the regulation 18(3)(a) Department of Employment and Labour certificate for that class of application and partly relaxed the timing of the SAQA-evaluation outcome in specified circumstances.
Check:
- correct route and adjudication system;
- proof of the SAQA-evaluation application if the outcome is pending;
- any translation and qualification evidence still required;
- the possible duration effect described in the waiver; and
- the waiver's express statement that no status is granted.
Mark BLOCK if the team has removed a record because “waivers apply” without identifying the paragraph and facts.
Gate 8: 2026 medical-report waiver
Ministerial Immigration Directive 10 of 2026 waived the prescribed medical-report requirement for future and pending visa and permanent-residence applications. Record the directive and confirm coverage.
If an older mission, centre or portal checklist still asks for the item, capture the discrepancy and the verified channel response. Do not mislabel a police clearance, medical-cover requirement or other route record as part of this medical-report waiver.
The result should be PASS when the legal waiver and operational handling are reconciled, not when the row is simply deleted.
Gate 9: document freshness and cross-field consistency
Use automated or two-person checks where possible. Confirm:
- required pages and reverse sides are present;
- scans are readable and uncropped;
- translations and certifications meet the current route;
- dates and validity periods are checked;
- names and identifiers are consistent;
- source records have not been altered;
- corrections preserve the prior version and explanation; and
- forms contain no blank mandatory fields or unresolved placeholders.
Run a search for the old employer name, old passport number, draft salary and abandoned role title across the final set. One forgotten attachment can reintroduce a contradiction.
Gate 10: privacy and secure handling
The final pack may contain high-risk identity and employment data. Confirm:
- the recipient and upload domain were independently verified;
- only necessary records are included;
- originals and submission copies are separated;
- access is limited to authorised people;
- filenames do not expose unnecessary personal details;
- the worker knows what is being submitted about them; and
- the return or retention plan is recorded.
Do not email the full pack to an address copied from an unverified message. Do not use production-like personal data to test an upload channel.
Gate 11: receiving channel and authorised submitter
Confirm the correct mission, application centre, office or portal for this worker, location and category. Record:
- current channel source;
- appointment requirement;
- who must appear or provide biometrics;
- who may submit or collect;
- accepted file type, size and naming rules;
- fee and payment route;
- original-document requirement; and
- how support or corrections are requested.
Digital reform announcements do not automatically move every work-visa application to a new portal. Use the operational route actually authorised for the case.
Gate 12: frozen release set
Create one numbered index and a read-only release folder. Give every file a stable name and version. Record:
- final form checksum or version;
- attachment number;
- source owner;
- sign-off status;
- waiver or legal-source reference; and
- any permitted post-submission original.
The submitter should be able to reproduce the exact pack reviewed. Mark BLOCK if documents can still be replaced without the reviewer knowing.
Gate 13: receipt, tracking and post-submission ownership
Before release, decide who will:
- capture the submission and payment receipt;
- verify the tracking reference;
- keep the final upload set;
- monitor requests and outcomes;
- record the date a decision is received;
- manage passport or original-document collection; and
- escalate an expiry, refusal or changed fact.
No receipt means no evidence of submission. A receipt proves a transaction or filing event; it does not necessarily prove completeness, approval or permission to work.
Gate 14: lawful interim work position
Write a separate sentence stating what the worker may do after submission. Base it on the existing status, conditions and any applicable current directive. Do not infer the answer from processing time, urgency, employer need or a planned start date.
If Immigration Directive 7 of 2026 is relied on, verify the applicant class, pending outcome, receipt, existing activity conditions and cessation event. The directive does not permit covered applicants to exceed the activities authorised by their current visa conditions.
Mark BLOCK if this sentence cannot be written from verified documents and advice.

Use this compact result:
| Gate | Result | Evidence | Block owner | Review date |
|---|---|---|---|---|
| Route/current law | PASS/BLOCK/N/A | Source and version | Name | Date |
| Points/transition | PASS/BLOCK/N/A | Calculation and authority | Name | Date |
| Employer/role | PASS/BLOCK/N/A | Final aligned records | Name | Date |
| Worker/status | PASS/BLOCK/N/A | Passport and status history | Name | Date |
| Waivers | PASS/BLOCK/N/A | Exact notice and facts | Name | Date |
| Channel/release set | PASS/BLOCK/N/A | Verified route and frozen index | Name | Date |
| Interim activity | PASS/BLOCK/N/A | Written status conclusion | Name | Date |
Submit only when every material row is PASS or correctly NOT APPLICABLE. Never override a block merely to keep an appointment; record the lawful resolution.
Legal disclaimer
This is a general South African release-control tool, not an official application checklist or legal opinion. The correct category, points, documents, waivers, channel and interim work position depend on the worker, employer, submission date, current notices and live instructions. A PASS is an internal readiness status, not a prediction of approval.
FAQs
What should an employer check immediately before submitting a foreign-worker visa application?
Run a documented release gate covering the correct legal route and version, points calculation, role and salary alignment, employer and worker identity, current status, applicable waivers, document consistency, secure channel and post-submission ownership.
What does a BLOCK result mean in the final visa check?
It means a material uncertainty or conflict remains. Name the exact issue, responsible owner, required evidence and resolution date; do not release the pack until the blocker is cleared and the affected records are rechecked.
Should the points calculation be checked independently before submission?
Yes. Recalculate from the current official notice and final evidence, confirm the mandatory factor and threshold, and retain a dated calculation record. Do not rely only on an earlier draft or a consultant's unsupported total.
How should current waivers be handled in the submission pack?
Record the exact official instrument, scope, date and application to the chosen route. The general-work waiver and 2026 medical-report waiver address different requirements and should not be treated as general exemptions or work permission.
What should the employer preserve after submitting?
Preserve the frozen submitted set, transmission or appointment evidence, official receipt, reference number, payment record, login or channel details, follow-up owner and the written interim-work position.
