Quick answer
Take the complete papers exactly as received, a note of when and how they reached you, proof of your marriage and property regime, records about children and maintenance, a current financial snapshot, every existing order and a short chronology. Do not wait for a perfect file before asking for help: the response instruction in the summons may be time-sensitive. The purpose of the pack is to let the lawyer verify the court process first and then identify what is agreed, disputed or still unknown.
Folder 1: the process and service record
Keep the summons, particulars of claim, annexures, notices, draft settlement, sheriff information, envelope and anything delivered later. Do not remove staples, rearrange the original set or write on it. Scan each page in order and keep the scan separate from the originals.
Create a cover sheet recording:
- the issuing court, division and case number;
- the plaintiff, defendant and legal representatives;
- the actual date, time, place, recipient and manner of service;
- the response instruction printed in the papers;
- every address stated for delivery of documents; and
- any missing page, inconsistent name or unclear stamp.
Divorce summonses are ordinarily served personally by the sheriff. If the papers arrived only by email, through a relative or in another informal way, preserve them but tell the lawyer exactly what occurred. Possessing a copy and being formally served are not always the same question.
Do not calculate the deadline from a generic article. The period can depend on the court, served form, service facts and current procedural rules. Ask the lawyer to write down the operative date, the calculation, the person responsible for the response and the proof that will show it was filed and delivered.
Folder 2: marriage, claims and existing orders
Include identity documents, the marriage certificate and the registered antenuptial contract if one exists. Add proof relevant to a customary marriage, civil union, foreign marriage or earlier marital-status dispute where applicable. Do not guess the matrimonial-property regime from whose name appears on an account or title deed.
Turn the summons into a claim table. For every material allegation and requested order, mark it agreed, disputed, partly agreed or not understood. Beside it, list the document that supports your position and the question requiring advice. Accepting that the marriage should end does not require automatic agreement with every property, maintenance, pension, child or costs claim.
Bring all existing court orders or formal agreements about maintenance, children, domestic violence, occupation of a home, property or another pending case. Add proof of payments, compliance or alleged breaches. A divorce summons does not automatically cancel a separate order.
Folder 3: children and support
For each child, gather the birth certificate or adoption record, current care and contact routine, guardianship information, school and medical details, significant expenses, transport arrangements and every parenting plan or order. Write down any immediate concern about safety, relocation, travel or disruption of the child's current stability.
Keep Family Advocate correspondence, questionnaires, appointment notices, reports and registered agreements in a separate section. The Office of the Family Advocate is neutral and child-focused; it does not become either spouse's lawyer and does not decide the adult property dispute.
Build a maintenance schedule showing existing amounts, actual payments, arrears claimed, household expenses, income, bank proof and the child's itemised needs. Separate child support from care and contact. Do not use one as leverage for the other.
Folder 4: money, property and retirement interests
Prepare recent payslips, bank statements, tax returns or assessments, employment terms and proof of bonuses, commissions, benefits, business drawings, distributions or rental income. If income changed, add records explaining when and why.
Create one asset schedule and one liability schedule. For each entry, record the legal owner, acquisition date, source of funds, current estimate, supporting record and treatment claimed in the summons. Include homes, land, vehicles, investments, policies, valuable movables, digital assets, home loans, vehicle finance, tax debts, suretyships and disputed obligations.
For companies, close corporations, partnerships or trusts, bring the documents you lawfully possess: founding records, ownership registers, financial statements, management accounts, tax records, loan accounts and existing valuations. Do not remove business originals or access another person's private account without authority.
For every pension or retirement arrangement, record the exact fund or scheme, member number, administrator and current benefit information. Generic pension wording can fail if it does not match the law, the fund and the proposed court order.
Settlement and communication file
Keep every proposal, marked draft, parenting proposal, undertaking and settlement communication with its date and version. Do not overwrite earlier drafts. Ask the lawyer which communications may be open, privileged or intended to be without prejudice before forwarding or relying on them.
If a draft is waiting for signature, do not sign merely because the divorce is described as uncontested. The document should be checked against the complete disclosure, children, maintenance, property, debt, pension, tax, transfer and implementation facts.
The one-page chronology
End the pack with a neutral sequence covering the marriage, separation, present child arrangements, support, major asset or debt changes, settlement discussions, issue and service of the summons and anything already filed or sent. Link each important event to a source document. Use dates and observable facts instead of accusations.
Secure the pack. Retain unedited originals, preserve available metadata, limit access to child and financial records and use the lawyer's approved sharing channel. Lawful preservation is useful; impersonation, guessed passwords and unauthorised account access are not.
What to send before the consultation
If time is short, send the process cover sheet and complete served set first. Then add the marriage records, claim table, urgent child or safety facts, existing orders and your current financial schedules. Label missing items instead of postponing the consultation.

FAQs
Should I wait until I have every bank statement?
No. Send the served process and deadline facts first. A lawyer can identify the priority gaps and the lawful disclosure route for records you do not control.
Do I need the sheriff's return of service?
Bring it if you have it, but do not delay advice because it is missing. Record exactly what happened and ask how the return or court file will be checked.
Should I send original documents to the other spouse?
Not without advice. Preserve originals securely and use copies through the appropriate procedural or agreed channel.
Should I bring my antenuptial contract if the summons states the marriage regime?
Yes. Bring the signed contract and registration details if available, together with the marriage certificate and any relevant foreign or customary-marriage material. The pleaded description should be checked against the controlling documents rather than accepted from the summons alone.
