Quick answer
Build a compact evidence pack that answers four questions: what type of suspension was imposed, what the employer said about pay, what remuneration was actually received, and what happened after the exclusion began. The pack should contain original records, a dated index and an honest list of gaps. It should not be a mass download of every workplace message.
How to use this guide
Start with the suspension notice and the first pay period affected. Those two records often expose the central uncertainty: the letter may describe a precautionary measure but say nothing about remuneration, while the payroll trail shows whether salary, allowances, deductions and benefits continued in practice.
Create a master index before arranging folders
Use an index with columns for document number, date, author, recipient, description, source and issue proved. Give each saved item a stable reference such as S01 or PAY03 and use that reference in the chronology. Mark whether the file is an original export, a scan, a forwarded copy or a screenshot.
The chronology should begin before the suspension if earlier events explain its purpose. Include the allegation or incident, meeting requests, the suspension decision, any review or extension, payroll dates, requests for clarity, responses, disciplinary steps and the current position. Where a date comes only from memory, say so. That distinction lets the lawyer separate established facts from matters that still need proof.
Collect the authority for the employer’s action
Place the employment contract, amendments, disciplinary code, suspension policy, applicable collective agreement and relevant workplace rule in one folder. Highlight the clauses dealing with precautionary exclusion, disciplinary sanctions, remuneration, deductions, availability and representation, but keep a clean copy as well.
Add records showing who made the decision and whether that person held the required authority under the employer’s policy. If a public-sector statute, collective arrangement or delegation may apply, identify it rather than assuming the private-sector template controls. The legal consequence of a missing approval depends on the governing instrument and the facts.
Preserve the employer’s stated purpose
Keep the first notice in the format in which it was received, including attachments and email headers. Add every later letter that changes the reason, length, access conditions or pay position. If the employer orally described the suspension as “pending investigation”, make a dated note naming the speaker, listener, location and words recalled, while clearly labelling it as a recollection.
A precautionary suspension and a punitive suspension serve different functions. The Constitutional Court’s judgment in Long v South African Breweries dealt with a precautionary measure on full pay and is relevant to the fairness analysis in that setting. A lawyer will need the actual notice and remuneration evidence before deciding whether its reasoning assists; a case name cannot substitute for the factual comparison.
Section 186(2)(b) of the Labour Relations Act includes unfair suspension and other unfair disciplinary action short of dismissal in the definition of an unfair labour practice. Collecting the records does not prove unfairness. It equips the adviser to examine purpose, duration, pay, prejudice, governing rules and subsequent procedure.
Build a payroll proof schedule
For at least three ordinary pay periods before suspension and every period after it, list gross salary, net salary, regular allowances, variable amounts, employer contributions, deductions and bank deposits. Attach the corresponding payslip and bank entry to each row. Where the payroll document and deposit differ, record the variance rather than choosing the version that looks more favourable.
Gather any payroll query, ticket number, HR response and corrected statement. Preserve benefit records for medical aid, retirement funding, vehicle use, housing, data or other material terms if they changed. An allowance linked to work actually performed may require a different analysis from basic salary, so identify its contractual trigger.
If no scheduled pay date has passed since suspension, record that expressly. The absence of an advance assurance is not yet the same evidence as a missed payment. Ask the employer a neutral written question about the next payroll treatment and retain its response.
Record compliance with suspension conditions
Save instructions about returning equipment, avoiding premises, remaining contactable, attending interviews and protecting confidential information. Keep proof that devices, keys or files were handed over and that you responded to lawful availability requests. If an instruction was impossible or unclear, retain the request for clarification.
Do not obtain evidence by accessing a system after authority has been removed, recording a protected conversation unlawfully or forwarding confidential customer material to a personal account without advice. Tell the lawyer what evidence may exist and where it is held. The lawful method for requesting or preserving it can then be considered without creating a new disciplinary allegation.
Capture process and prejudice without exaggeration
Include investigation invitations, allegations, charge sheets, hearing notices, postponements, grievance documents and review requests. For each, note the delivery date and response deadline. If the employer gave no update for a long period, show the unanswered follow-ups rather than relying on a general statement that nothing happened.
Maintain a prejudice log limited to verifiable effects. Examples might include a missed contractual payment, loss of system access needed for an agreed task, a professional-registration consequence, medical-aid interruption or a documented reputational communication. Separate actual loss from worry or prediction. This helps the adviser evaluate urgency and remedy without overstating the evidence.
Include adverse and ambiguous material
Do not exclude an email because it shows that you initially agreed to a condition, missed a call or knew of an investigation. Flag it in the index and explain the context. A complete early view allows the lawyer to adjust the advice before the employer produces the same record at conciliation or arbitration.
Keep message threads together, export chats with participant and timestamp information, and avoid annotating the only copy of a document. Store your comments in a separate analysis note. If a screenshot is unavoidable, include enough surrounding material to show context and state who captured it and when.
Add a deadline and forum sheet
Current CCMA guidance generally describes a 90-day period for referring an unfair-labour-practice dispute from the act or omission, or later awareness. Put every candidate trigger on the sheet: initial suspension, extension, missed pay date and punitive decision. Do not decide privately which one controls, and do not assume a grievance has interrupted the period.
Add the employer’s sector, workplace, legal name and any bargaining-council reference found on contracts or payslips. The lawyer can then investigate whether a council or the CCMA has jurisdiction. If a date may already be late, preserve the true timeline for possible condonation advice rather than revising it.
Deliver a reviewable consultation bundle
The final bundle should contain the master index, chronology, authority documents, suspension communications, payroll schedule, process material, compliance proof, prejudice log and deadline sheet. Keep bulky duplicates and unrelated messages in a separate archive available on request.
On the cover page, identify the three facts that remain unknown and the three decisions you need from the lawyer. Ask which evidence gap has legal significance, whether a targeted written request should be made, what forum and timing need protection, and what limited review can be completed for an agreed fee. A well-built pack reduces reconstruction time while leaving the legal conclusions to the adviser.
Important limitation
This is general South African labour-law information, not legal advice or a calculation of any person's deadline. For a suspension where the pay position is unclear, employment status, collective agreements, public-sector rules, protected grounds and the exact event date can change the route. Preserving adverse and incomplete records is part of sound preparation; do not reshape the file to fit a preferred story.
FAQs
How should I organise labour evidence?
Use a dated chronology and folders for terms, process, reasons, money, communications and remedy. Link each important assertion to a record.
Should I include documents that weaken my position?
Yes. A lawyer needs material adverse facts early to assess risk, credibility and the best lawful response.
What if an employer record appears inaccurate?
Preserve it unchanged, identify the disputed statement and attach objective material supporting the correction. Do not edit the employer's copy.
Are witness names enough?
Record what each person directly saw or heard, when it occurred and how they can be contacted. Avoid coaching or producing a shared script.
