Quick answer
Get urgent labour-law help when the suspension threatens an immediate loss of pay, requires a quick decision about signing an unpaid sanction or separation document, overlaps with a disciplinary hearing, appears retaliatory or discriminatory, or may be approaching the unfair-labour-practice referral limit. Send the suspension notice, last payslip, contract or policy and the nearest date first.
How to use this guide
Uncertainty about pay should be resolved before the next normal payroll point where possible. A precautionary or investigatory suspension is ordinarily on pay, while unpaid disciplinary suspension ordinarily depends on the employee's agreement. Legislation, a collective agreement, an employment contract or another valid instrument can add requirements, so the label on the letter is not the final answer.
Use the next irreversible event as the urgency test
Write down the next event that could cause real prejudice: payroll closure, a deadline to accept unpaid suspension, a hearing, expiry of an internal appeal, deletion of system access, return of equipment, or a possible external referral date. Legal help is urgent when advice received after that event would be less useful.
Do not wait for the employer to clarify every fact. A lawyer can give a bounded opinion on the immediate step while the full record is collected. The early deliverable should state what to send, what not to sign, who must be contacted and which clock still requires verification.
Escalate before pay is withheld
If the suspension letter is silent about remuneration, ask in writing whether basic pay, ordinary benefits, allowances, commission treatment, medical aid and retirement contributions will continue. Keep the response and compare the following payslip and bank credit with the normal cycle.
The Basic Conditions of Employment Act regulates payment information and deductions. A reduction cannot safely be analysed from the gross deposit alone; the contractual basis, work-related variable pay, deductions and payroll explanation all matter. Ask for a written breakdown rather than accusing payroll of theft before the amount is known.
Urgent advice is warranted if the employer confirms no pay, asks for consent to an unpaid period, skips a scheduled payment or makes a large unexplained deduction. Financial hardship makes the matter practically urgent, but it does not itself prove an unfair labour practice.
Act quickly when the suspension changes character
A letter may begin as precautionary exclusion and later become a disciplinary penalty. Warning signs include language of punishment, a fixed unpaid period, a guilty finding, or an agreement describing the suspension as a sanction. Ask which event changed the basis and whether the employee consented.
The CCMA's current unfair-labour-practice guidance distinguishes paid precautionary suspension from an unpaid disciplinary suspension that ordinarily requires agreement. Do not sign an “acknowledgement” without checking whether it actually records consent, waives a challenge or resolves the underlying allegation.
If the employer issues charges or a hearing notice while the suspension continues, obtain advice on the hearing preparation separately. A suspension dispute does not cancel the employee's duty to respond to a lawful disciplinary process.
Identify referral urgency without using a generic date
Section 186(2)(b) of the Labour Relations Act includes unfair suspension and unfair disciplinary action short of dismissal within unfair labour practice. Section 191 generally uses a ninety-day period for referral from the act or omission, or from when the employee became aware of it. The trigger can be disputed where notices, pay decisions or later changes occur.
Do not assume a continuing suspension creates a fresh ninety days every morning. Do not assume an internal grievance, appeal, union discussion or request for information stops the statutory clock. Give the adviser the first exclusion date, pay communication, every extension and the date each was received.
If the likely period is already old, urgency increases because condonation may be required. The employee should preserve a full explanation for delay rather than waiting for the merits file to become perfect.
Prioritise short disciplinary dates
A hearing set during suspension may require an immediate document request, representation decision, postponement request or witness plan. Treat the charge, hearing and suspension as connected facts but distinct legal questions.
The 2025 Code of Practice: Dismissal guides disciplinary fairness and the opportunity to respond. It does not make every pre-hearing suspension fair or unfair. Ask whether the hearing date is realistic and what can be done without disobeying a lawful instruction.
CCMA Rule 25 also means legal representation is not identical at conciliation and arbitration. Urgent advice can still cover preparation and route control even if a lawyer cannot appear as of right at every stage.
Escalate retaliation, discrimination and safety separately
Promptly disclose facts suggesting the suspension followed a protected disclosure, union activity, discrimination complaint, pregnancy-related issue, safety report or exercise of a statutory right. These facts may engage routes beyond ordinary unfair suspension and can carry different elements or forums.
Sequence matters. Record what was reported, to whom, when, who knew about it and what happened next. Close timing may justify investigation, but it is not a substitute for proving the protected act and causal connection.
If the employee faces threats, violence or serious health risk, use the appropriate emergency, occupational-safety or protection channel. A CCMA referral is not immediate physical protection.
Preserve evidence before access disappears
Suspension often removes system and building access. Save only documents already lawfully available and relevant to the employment issue. Do not use another person's credentials, circumvent controls, delete company data or send client information to a personal account.
Make a dated inventory of equipment returned, access disabled, meetings missed and records no longer available. Ask the employer to preserve relevant notices, payroll material, policy versions and investigation communications where appropriate. A focused preservation request is safer than a mass download.
Avoid turning urgency into resignation
Suspension can be humiliating and financially frightening, but resignation changes the employment relationship and may create a different dispute. Do not resign simply to force the employer to state its case. Get advice on pay, the investigation, working alternatives, health evidence and the disciplinary timetable first.
Likewise, do not refuse every instruction, contact witnesses against a clear lawful direction, publish accusations or stage a return to the workplace. An urgent strategy should protect options rather than create new allegations.
Send a rapid assessment bundle
The first email to the lawyer can contain:
- the suspension notice and delivery date;
- the nearest payroll, signature, hearing or referral date;
- the last two payslips and bank-payment dates;
- the employment contract, policy and collective terms available;
- any charge, investigation or hearing document;
- a short chronology of extensions and pay communications;
- the employee's desired immediate result; and
- a list of missing records.
Ask for a written answer on pay status, suspension type, immediate response, external route, deadline responsibility and the scope of the next task. That focused instruction addresses the true urgency without asking the lawyer to decide the entire employment case in one call.
Important limitation
This is general South African labour-law information, not legal advice or a calculation of any person's deadline. For a suspension where the pay position is unclear, employment status, collective agreements, public-sector rules, protected grounds and the exact event date can change the route. Urgency is fact-specific and does not convert general information into a court order, deadline calculation or guaranteed remedy.
FAQs
Do I need every document before getting urgent advice?
No. Send the triggering document, the nearest date and a short chronology. The fuller bundle can follow after immediate risk is addressed.
Is financial pressure alone proof that the labour claim succeeds?
No. It can make practical help urgent, but legal outcome still depends on the applicable right, process and evidence.
Should I resign to end an urgent workplace problem?
Not before obtaining advice on the legal and financial consequences. Resignation can change the dispute and available remedy.
Can internal discussions replace referral planning?
They may resolve the dispute, but do not assume they pause a statutory period. Track both processes separately.
