Quick answer
Before speaking to a South African immigration lawyer about a work visa, prepare an applicant brief rather than an unfiltered folder of documents. Record where you are, what immigration status you hold, what work is proposed, which route may fit, what points you think you can prove, what happened in earlier applications and which dates control your next decision.
How to use this guide
The brief should help the lawyer answer a defined question: which route fits the real facts, what may you lawfully do now, what evidence is missing and what must happen before filing. It is not the final application checklist and it should not hide an awkward fact simply because the fact may complicate the route.
Start with the decision you need
Write one sentence at the top of the brief. Examples include:
- classify a first General or Critical Skills Work Visa application;
- check whether an intended role and offer can meet the current points framework;
- decide where an application may be submitted;
- review the effect of a current South African visa and its conditions;
- assess a prior refusal, pending appeal or status gap; or
- advise whether a proposed start, employer change or trip must be paused.
Do not ask only whether you “qualify”. A useful consultation separates route classification, document sufficiency, current status and operational decisions. The lawyer may need to answer those questions differently.
Record your present location and status
State your nationality, current country and whether you are inside or outside South Africa. If you are in South Africa, copy the visa category, conditions and expiry date exactly as they appear. Add the date of your last entry, the passport used and any receipt for a pending application, waiver or appeal.
Do not infer work authority from a booking, payment or filing receipt. Immigration Directive 7 of 2026 creates temporary measures for defined groups with pending waiver, long-term-visa or appeal applications until 30 June 2027, but it has strict eligibility and receipt requirements. It also says applicants may not engage in activity beyond what their current visa conditions permit. Ask the lawyer to test the directive against your exact facts rather than writing “concession applies” in the brief.
Describe the proposed work without improving it
Summarise the offer as it actually exists:
- employer and South African employing entity;
- job title and core duties;
- work location and reporting line;
- proposed start and end dates;
- gross remuneration and currency;
- whether the offer is signed and conditional; and
- whether the employer claims recognised Trusted Employer status.
Attach the offer or draft contract, but do not rewrite duties to resemble an occupation on the Critical Skills List. A title, salary or employer label is not enough on its own. The lawyer needs the unedited facts to assess the statutory route and points evidence.
Build a provisional personal points snapshot
Government Notice 5448 of 18 October 2024 applies a 100-point framework to General and Critical Skills Work Visas and makes an offer of employment mandatory. For the consultation, prepare a provisional table without declaring yourself eligible:
| Criterion being considered | Evidence you hold | What remains uncertain |
|---|---|---|
| Occupation | Offer, duties and possible Critical Skills List entry | Exact occupation and OFO mapping |
| Qualification | Award certificate, academic record and SAQA position | NQF comparison and translation |
| Work experience | Employer letters and dates | Whether duties and duration are adequately proved |
| Employment offer | Signed offer or contract | Gross remuneration, employer identity and conditions |
| Language or employer status | Current evidence, if any | What the notice requires and whether the claim is recognised |
Use the corrected 18 October notice, not the withdrawn 9 October version or a press summary. Let the lawyer calculate the points from the documents and explain which factor is mandatory, which evidence is weak and what happens if one item is rejected.
Disclose qualifications and professional status
List every qualification you intend to rely on, the awarding institution, country, completion date and whether SAQA has evaluated it. If an application is pending, include the SAQA submission reference and date. SAQA says the qualification holder must use their own account and contact details for a foreign-qualification evaluation.
If the occupation involves a professional body, record any registration, candidate status, supervision condition or unanswered application. Do not describe membership, a short course or an uncompleted qualification as an evaluated degree. The October 2024 ministerial waivers give limited treatment to proof of a pending SAQA evaluation for points-based General and Critical Skills applications; the waivers do not grant immigration status.
Give the full immigration history
Create a dated list of previous South African visas, applications, receipts, decisions, appeals, waivers, entries and exits. Include a refusal, cancellation, overstay finding or undesirable-person notice even if you believe it was incorrect. Record when you received each decision, not only the date printed on it.
Explain name changes, passport replacements and any period when the employer, role, location or activity differed from the visa conditions. A lawyer cannot give reliable advice from a cleaned-up chronology that omits the event most likely to change the route.
Separate applicant records from employer-controlled records
Mark each missing fact as APPLICANT, EMPLOYER, ISSUING BODY or LEGAL DECISION. This prevents the consultation from ending with an undifferentiated request for “more documents”.
You control passport history, personal applications, many clearances and the SAQA account. The employer controls its corporate particulars, authorised signatory, undertakings, role description and employment records. An issuing body controls qualification verification or professional registration. The lawyer should identify which missing item is truly required for the route and who can lawfully supply it.
Add a date and travel sheet
Record passport expiry, current visa expiry, proposed start, booked or intended travel, appointment dates, application or appeal dates, document issue dates and any official response deadline. Do not rely on a general processing estimate to decide when to resign, start work or buy travel.
Home Affairs Directive 10 of 2026 now waives the prescribed medical-report requirement for future and pending visa and permanent-residence applications. That does not remove unrelated requirements such as police-clearance evidence or make an older checklist reliable as a whole. Flag every older checklist so the lawyer can reconcile it with the current directives.
Assemble the applicant consultation brief
Keep the first handover compact:
- the decision you need;
- location, present status and exact conditions;
- proposed employer, role, duties, pay and dates;
- provisional points snapshot;
- qualification, SAQA and professional-body position;
- complete immigration chronology;
- applicant-, employer- and issuer-controlled gaps;
- live expiry, travel and response dates; and
- three contradictions or assumptions you want tested.
Send sensitive passport, police-clearance and family records only through a verified secure channel. Confirm the lawyer or firm independently before uploading them.
FAQs
Can I consult a lawyer before every work-visa document is ready?
Yes. Prepare the route question, current status, job facts, points snapshot, immigration history and controlling dates. The consultation should identify missing evidence and who controls it.
Does a pending work-visa application let me work?
Not automatically. A filing receipt is not work authority. Ask which current visa condition or official measure permits the exact employer and activity.
Should an employer create my SAQA account?
No. SAQA says the qualification holder must use their own account and contact details. Employer or legal support does not transfer control of the evaluation.
What should the first consultation produce?
Request a written route, points, status and evidence decision with assumptions, missing items, responsible owners and next-action dates.
