Quick answer
Get urgent immigration advice when you cannot safely answer one of three questions: may I stay in South Africa, may I perform the proposed work, and may I travel and return? Treat an approaching expiry, a refusal or appeal date, work before clear permission, a change of employer or duties, a missing verifiable receipt, possible false information, or imminent travel as advice-before-action problems.
How to use this guide
Urgency does not mean every work-visa application needs an emergency filing. It means a delay or impulsive step could change status, evidence, a legal remedy or the applicant's ability to comply. Preserve the records, pause the risky activity where it is safe to do so, and ask for written advice tied to the exact visa conditions and current official instrument.
“Pending” does not answer three permission questions
A booking, payment, job offer, VFS receipt or pending application proves an event. It does not automatically answer:
- STAY: what currently authorises your presence and until when;
- WORK: what employer, role, location and activity are currently permitted; and
- TRAVEL: what document supports departure and re-entry, including any port-of-entry visa requirement.
Write each answer separately. If one answer rests only on “the application is in process”, mark it unresolved.
Stay: expiry or status is uncertain
Escalate when a current visa is close to expiry, the applicant cannot find the original condition, the recorded status differs from the passport or a previous application outcome is unclear. Add the last entry, current visa, expiry, submission receipt and every decision or appeal record to a short chronology.
Immigration Directive 7 of 2026 grants narrowly defined temporary measures through 30 June 2027 for certain lawfully admitted applicants with pending waiver, long-term-visa or appeal outcomes. It requires a verifiable VFS receipt and contains exclusions. It does not apply to pending permanent-residence applications, and its protection ends when an outcome is received. Do not treat the date alone as a universal extension.
Work: the proposed activity may not match the condition
Obtain advice before starting or continuing work if the visa does not plainly cover the actual employer and activity, the employer or role changed, duties moved to another entity, the worksite changed materially or somebody proposes “training”, “volunteering” or remote work as a label for the same productive activity.
Directive 7 expressly says qualifying pending visa and appeal applicants may not engage in activity beyond what their current visa conditions provide for. A work-visa application, points estimate or employer assurance is not itself work authority. Ask which exact document and condition supports the work now.
Do not backdate a contract, alter a role description or create a false pause in the record. Preserve schedules, instructions, payslips, access records and communications if work may already have taken place outside a clear condition.
Travel: departure or return is imminent
Travel needs urgent advice when the applicant plans to leave South Africa while a waiver, visa or appeal is pending, holds a passport from a non-visa-exempt country, has an expired or replaced passport, or relies on a concession without the specified proof.
Directive 7 contains travel measures for defined pending matters, but it distinguishes applicants from visa-exempt and non-visa-exempt countries and requires documents such as the relevant receipt or appeal record. A general statement that travel is “allowed under the concession” is not enough. Record destination, departure and return dates, passport, present status, pending process and every document that would be presented at the port.
Avoid non-refundable travel until the particular re-entry position has been checked. An airline's boarding decision and Home Affairs' legal determination are different questions.
A refusal, appeal or official request has a live date
Treat the day a decision or request was actually received as evidence. Preserve the email headers, portal notice, collection receipt or delivery record. Do not calculate a response or appeal date from memory or from another person's case.
Send the lawyer the complete decision, filed bundle, proof of submission, proof of receipt and current status. The correct response may be clarification, a section 8 process, a new application, review advice or another step. Preparation cannot extend a legal or administrative deadline.
The employer, job or facts changed after planning began
A change in employer, employing entity, job title, duties, remuneration, work location, reporting structure or contract duration can affect route, points and conditions. Escalate before silently substituting a new offer or carrying an old points calculation into the final application.
Create a before-and-after table and ask:
- does the route still fit;
- do the claimed points still have evidence;
- must an application, authority or condition be changed; and
- what may the applicant lawfully do during the transition?
A receipt or application cannot be verified
Treat a missing or mismatched VFS reference, payment receipt, appointment record or submission copy as urgent when status, travel or a concession depends on it. Ask the submitter and official channel for a traceable record. Do not fabricate a replacement or rely on a cropped screenshot that omits the applicant, category or date.
Directive 7 specifically requires a verifiable receipt against the VFS tracking system. If that cannot be produced, the applicant needs advice on the resulting position, not a stronger assertion that the filing happened.
Information may be false, altered or contradictory
Stop before submission if a qualification, experience letter, police clearance, employment record, bank detail, translation or passport page may be false or edited. The current General and Critical Skills checklists state that supporting documents may be verified and that the applicant is personally responsible for them.
Do not delete messages, coach an issuer, change metadata or send a second version without an explanation. Preserve the item and the chain by which it was received, then obtain independent advice.
Complete the three-permission urgency card
| Permission lane | Current document or condition | Controlling date | Contradiction or risk | Safe immediate action | Advice needed |
|---|---|---|---|---|---|
| STAY | Visa, receipt, decision or directive relied on | Expiry or outcome date | Status unclear | Preserve records; avoid unsupported claims | Exact current status and next lawful step |
| WORK | Visa condition and actual role | Proposed start or change date | Employer or activity mismatch | Pause new activity if safe | What work is presently authorised |
| TRAVEL | Passport, status and pending record | Departure and return | Re-entry proof uncertain | Delay non-refundable booking | Departure and re-entry position |
Add the person responsible and the time by which advice is needed. The card is a triage tool, not permission to stay, work or travel.
Minimum pack for urgent advice
Provide the passport biodata and relevant visa pages, current visa or status document, pending-application or appeal receipt, decision or request, job offer and actual duties, short chronology, intended travel and the three-permission card. Send private records through a verified secure channel.
If detention, removal, an undesirable-person decision, an expired status or a live court deadline is involved, say so at the start. This page does not replace the specialist advice those matters require.
FAQs
Is every approaching work-visa expiry an emergency?
It needs prompt triage, but the lawful response depends on current status, filing eligibility, the exact date and any pending process. Preparation alone does not extend status.
Can I keep working because my application is pending?
Not merely because it is pending. Identify the exact current visa condition or official authorisation that covers the employer and activity. Directive 7 of 2026 does not expand existing activity conditions.
Can I travel while a waiver, visa or appeal is pending?
Do not assume so. Directive 7 has defined receipt and travel rules and distinguishes applicants from visa-exempt and non-visa-exempt countries. Check the passport, pending matter and re-entry proof before travel.
What should I preserve after a refusal or official request?
Keep the complete decision or request, filed bundle, receipt, proof of when it was received, current status records and correspondence. A live response or appeal date should be calculated from verified evidence.
