Quick answer
Begin with the suspension notice, proof of delivery, employment terms governing discipline, recent payslips, payroll communication, any charge or investigation notice, the employer's stated reason and every extension of the suspension. These documents establish whether the exclusion is precautionary or punitive, whether remuneration continues, who authorised it and when an unfair-labour-practice period may have started.
How to use this guide
Do not bury those records inside a complete personnel history. A useful suspension pack is arranged around five questions: what happened, under which power, for what purpose, with what pay consequence, and for how long.
Document set one: the suspension instrument
Keep the letter, email, message or meeting note that first excluded the employee from work. Preserve the complete version, attachments, sender details and the time it was received. Record whether the notice prohibits workplace entry, colleague contact, system access or discussion of the investigation.
Extract the employer's own words about purpose, pay, duration, allegations, review and conditions. “Precautionary”, “pending investigation”, “disciplinary”, “without pay” and “until further notice” have different implications, but no heading decides fairness without the surrounding facts.
If the suspension was oral, make a dated recollection identifying the speaker, authority, witnesses, exact instruction and subsequent conduct. Keep later written confirmation separate rather than rewriting the first account.
Document set two: authority and governing terms
Collect the employment contract, disciplinary code, suspension policy, collective agreement, bargaining-council agreement and any statute or regulation applicable to the role. Add delegations or organograms if the authority of the decision-maker is genuinely disputed and lawfully available.
Mark the version and effective date of every policy. A current intranet document may differ from the rule in force when suspension began. Do not import an undated policy from another employer or industry and represent it as controlling.
The CCMA's current guidance provides an important general distinction: precautionary or investigatory suspension is ordinarily paid, and unpaid disciplinary suspension ordinarily requires employee agreement. Governing legislation and employment instruments can create additional requirements, so the file must show which rule may apply.
Document set three: proof of remuneration and deductions
Provide payslips from before and during the suspension, bank confirmations, remuneration schedules, benefit statements, commission rules and payroll queries. Identify the normal payday and each component that changed.
Separate basic pay, fixed allowances, variable earnings, medical aid, retirement contributions, overtime, incentives and deductions. A lower deposit may reflect several causes; the employer should be asked for the written pay basis before the employee states that the entire suspension is unpaid.
The Basic Conditions of Employment Act is relevant to payment particulars and deductions. Retain any written consent, disciplinary outcome, court order, arbitration award or collective term said to authorise a reduction. Do not sign a retrospective consent merely to obtain an explanation.
Document set four: investigation and disciplinary process
Keep allegations, investigation invitations, requests for information, charge sheets, hearing notices, postponement decisions, witness communications and outcomes. The article is about suspension, but these papers reveal whether exclusion is genuinely protective, has become punishment or is connected to an imminent hearing.
Record the employer's stated risk: interference with witnesses, documents, safety, systems or operations. Then attach facts relevant to that risk, including access permissions, alternative duties, remote work proposals or safeguards raised by the employee. Do not contact witnesses in breach of a lawful instruction to manufacture evidence that suspension was unnecessary.
The 2025 dismissal Code guides fair disciplinary handling. Use it for current process context without treating suspension as a dismissal or assuming every procedural rule for final dismissal applies identically beforehand.
Document set five: duration and review
Create a schedule of the start date, initial end or review date, each extension, reason provided, investigation step and communication seeking progress. An open-ended suspension deserves a record of what the employer did and what the employee asked, not only a calculation of calendar days.
Retain meeting cancellations, postponed hearings and promises of an update. Mark which delay is attributable to the employee, employer, representative, illness or external investigation. Duration fairness depends on context; the longest period is not automatically the strongest case.
Long v South African Breweries concerned a full-pay precautionary suspension on its own facts. It should not be quoted as a universal approval of every exclusion or as a rule that policies, collective agreements and prejudice never matter.
Document set six: the employee's response
Keep the employee's written objection, grievance, request for reasons, pay query, proposed safeguards and internal appeal. Preserve the employer's answer and proof of delivery. A careful response can show disputed facts and alternatives without turning the exchange into a lengthy merits trial.
Where the employee accepted a disciplinary suspension or settlement, include every draft and the circumstances of signature. Consent, consideration, advice and wording may need review. Do not provide only the signature page.
Add communications that weaken the employee's case, such as a clear paid-status confirmation, a policy acknowledgment or evidence of delay caused by the employee. Selective files produce unreliable advice.
Document set seven: referral and forum control
Prepare a cover page with the employer's legal name, workplace, union, possible bargaining council, suspension date, awareness date, later pay decision and current status. Section 186(2)(b) of the Labour Relations Act places unfair suspension within unfair labour practice, and section 191 generally requires referral within ninety days of the act or omission or awareness.
The precise trigger must be determined from the record. Do not assume that every extension restarts time or that an internal grievance stops it. Keep proof of any referral, service, case number and condonation document.
If the matter proceeds, CCMA Rule 25 affects when legal representation is available. Include the dispute description and scheduled stage so the adviser can explain who may attend.
Build the priority pack in order
For the first consultation, send:
- suspension notice and extensions;
- contract, policy and collective terms;
- two pre-suspension payslips and every affected payslip;
- payroll explanation and bank proof;
- charges, hearing or investigation documents;
- internal objections and responses;
- a duration-and-pay chronology; and
- the referral control page.
Use filenames showing date and source. Preserve original email exports, audio and spreadsheets, and annotate copies only. Put missing documents in a request table with holder, relevance, request date and response.
The best document pack does not argue that every employer record is false. It lets a practitioner decide the suspension type, pay position, authority, fairness, timing and next procedure from a traceable source record.
Important limitation
This is general South African labour-law information, not legal advice or a calculation of any person's deadline. For a suspension where the pay position is unclear, employment status, collective agreements, public-sector rules, protected grounds and the exact event date can change the route. A complete bundle does not prove unfairness; the reliability and legal relevance of each record still need assessment.
FAQs
Should I send every employment document to the lawyer?
Start with a dated index and the records tied to the disputed decision, procedure, pay and remedy. Add background material when it answers a defined question.
What if I do not have the employer's policy?
Note the gap, ask for the version said to apply at the time and preserve the request. Do not rely on an undated policy found elsewhere.
Are screenshots enough?
They can be useful, but keep exports or original devices where possible and preserve dates, participants and surrounding context.
May I rewrite incomplete hearing or meeting notes?
Keep the original notes unchanged. A separate, dated recollection can explain gaps, but it should never be presented as a contemporaneous record.
