Quick answer
Yes. A dismissed employee may refer and conduct a CCMA case without a lawyer. Self-representation is normal and the CCMA provides referral forms and process guidance. But “you do not need a lawyer” is different from “a lawyer may appear at every stage”. Legal representation at the CCMA is controlled by section 138(4) of the Labour Relations Act 66 of 1995 and current Rule 25, with different rules at conciliation, con-arb, arbitration and preliminary proceedings.
How to use this guide
First identify the forum and stage. A bargaining council may have jurisdiction instead of the CCMA and may use its own rules. Confirm whether the issue is a dismissal, unfair labour practice, discrimination, contractual claim or another dispute. Then protect the referral date. A dismissal referral is generally required within 30 days of the dismissal or, if it is a later date, the employer’s final decision to dismiss or uphold the dismissal. Condonation may be requested for a late referral, but it is not guaranteed.
You may refer your own dispute
The CCMA’s official dispute-referral process allows an employee to lodge the prescribed referral and serve it as required. The form must identify the parties, dispute, date and outcome sought. A signed referral, proof of service and CCMA case number should be preserved.
Before choosing the CCMA, check whether a collective agreement assigns the dispute to an accredited bargaining council. Check too whether the person was legally an employee and whether the alleged dismissal fits the Labour Relations Act. These jurisdiction questions can be determined before the merits and can end a case even where the underlying treatment feels unfair.
Prepare a compact case file:
- employment contract, job description and policies;
- payslips and proof of the employer’s legal identity;
- disciplinary notice, charge sheet, hearing record and outcome;
- appeal or grievance documents and final outcome;
- dismissal letter and proof of when it was received;
- relevant emails, messages, attendance or performance records;
- names of witnesses and what each directly observed; and
- referral, service proof, CCMA notices and correspondence.
Do not rewrite messages, coach witnesses or discard unhelpful records. Make a factual chronology that separates allegation, evidence, employer reason and your response.
Representation at conciliation is restricted
Conciliation is a confidential settlement process, not the arbitration of evidence. Under current Rule 25, a party may appear personally. An employer may be represented by a director or employee, subject to the rule. Qualifying trade-union or employers’ organisation office-bearers, officials or members may represent parties within the rule’s conditions.
A legal practitioner is not ordinarily entitled to represent a party in conciliation proceedings. There are specific contexts and rule-based questions, but a dismissed employee should not arrive assuming a lawyer will be allowed to speak merely because the lawyer prepared the case. The employee can still obtain advice before the session, bring a settlement range, organise documents and ask the commissioner to explain the process.
Do not treat absence of legal representation as a reason to ignore conciliation. The session may resolve the dispute, narrow issues or produce a certificate enabling the next stage. Any settlement should be read carefully: parties, payment, dates, tax treatment, confidentiality, withdrawal, default, enforcement and the scope of “full and final” wording matter.
Arbitration has a different Rule 25 matrix
At arbitration, legal representation is generally allowed, but current Rule 25 restricts it in disputes about dismissal for conduct or capacity and in certain Basic Conditions of Employment Act matters brought within the CCMA’s statutory jurisdiction. In a restricted matter, a lawyer may participate if all parties and the commissioner consent, or if the commissioner concludes that it would be unreasonable to expect a party to deal with the dispute without legal representation after considering the rule’s factors.
Those factors include the nature of the questions of law, complexity, public interest and the comparative ability of the parties or representatives to deal with the arbitration. Permission is a procedural decision, not a reward for one party or proof that the case is strong.
Rule 25 also addresses representation in preliminary or in-limine proceedings and other specified contexts. Con-arb requires care because conciliation can move directly into arbitration. Ask in advance which parts are scheduled, whether a party may object to immediate arbitration where the Act permits it, and what representation ruling may be needed.
Alternatives to a lawyer appearing
Depending on Rule 25 and the party’s status, representation may be available from a registered trade union or employers’ organisation, a director or employee, or another listed qualifying representative. “Consultant”, “labour expert” or “friend” is not a free-standing right of appearance. The person must fit an authorised category and may have to prove it.
Even where a lawyer cannot appear, legal advice can help with jurisdiction, condonation, the issue statement, evidence, witness order, settlement terms and preparation for cross-examination. Agree in writing whether the practitioner is advising only, drafting papers, preparing witnesses or seeking permission to appear. Confirm fees and what happens if representation is refused.
Present a self-represented arbitration clearly
Start with a short opening: the dismissal date, reason given, why substantive or procedural fairness is disputed, and the remedy sought. Submit documents in a paginated bundle and be ready to show authenticity and relevance. A document does not prove itself merely because it is in the bundle.
Lead each witness through personal knowledge in chronological order. Ask the employer’s witnesses focused questions about disputed facts. Avoid speeches disguised as questions. When giving your evidence, answer honestly, accept facts that are not disputed and explain inconsistencies rather than hiding them.
The employer ordinarily must prove a fair reason and fair procedure once dismissal is established, but the exact evidential burdens depend on the dispute. A commissioner decides on evidence and law, not on which party has the more emotional story.
Protect every process boundary
Confirm the dismissal trigger, referral period, service method and correct forum from the actual documents. A late referral needs a condonation application addressing the degree of lateness, explanation, prospects, prejudice and importance. Condonation is discretionary; filing it does not guarantee the case will be heard.
Watch CCMA notices for conciliation, con-arb, arbitration, postponement and virtual-access instructions. If attendance becomes impossible, act immediately through the stated process. Do not assume a private agreement with the employer changes a CCMA date.
Self-representation can be suitable for a focused factual dispute with accessible evidence. Early advice is more valuable where jurisdiction is contested, the case involves automatically unfair dismissal, discrimination, whistleblowing, complex evidence, senior employment, parallel proceedings or serious financial consequences.
Important limitation
This is general information, not advice on a particular dismissal. Jurisdiction, the referral trigger, bargaining-council rules, condonation, representation and the evidence needed must be checked for the actual matter.
FAQs
Can my friend speak for me at a CCMA dismissal case?
Not simply because the person is a friend. Rule 25 lists authorised categories of representatives. A person who does not fit one of them has no automatic right to appear, although the employee may obtain private preparation support outside the hearing.
May a lawyer sit in during CCMA conciliation?
A legal practitioner has no ordinary right to represent a party at conciliation. The commissioner applies the current rules to the actual proceeding. Confirm the position beforehand instead of assuming that attendance or speaking rights will be granted.
What happens if legal representation is refused at arbitration?
The arbitration may proceed with the party self-represented or with another qualifying representative. Prepare the evidence and witness sequence on that basis, and agree beforehand what limited role an adviser will perform if appearance is not permitted.
Does representing myself extend the dismissal referral deadline?
No. The ordinary dismissal period and any condonation question apply regardless of representation. Calculate the trigger from the dismissal or later final decision and preserve proof of referral and service.
